Do you believe that we should be protected by a genuinely objective and impartial judiciary – that has no unhealthy overlap with the States?

PEOPLE’S PARK.
Many people will have been dismayed at the failures of Jersey’s prosecution system and its courts to bring child abusers to face justice.
The well-connected – the wealthy – and the powerful seem to get away with their crimes - and their failures to do their duty in protecting children – whilst the victims of these terrible crimes are marginalised and ignored.
It was these considerations which originally motivated the organisers of this public protest movement.
But the more we have explored the issues – the clearer it has become to us that the entire administration of justice in Jersey is hopelessly defective – in many different ways.
It isn’t only abuse survivors who have been failed and betrayed by the Jersey judicial system; people from all walks of life have been let down – in many different ways - time and again.
So whilst initiated by child protection failures, the protest which will be taking place this Saturday will be expressing much broader concerns.
A cross-section of our community will be launching a campaign for genuine, affordable, objective and accessible justice – justice for all – not only the well-connected and the wealthy.
A Protest for Justice on Saturday 4th July 2009 had been planed on behalf of victims of child abuse - both past and present. This protest was in response to the Attorney General’s decision not to prosecute former States employees against whom there is overwhelming evidence that they were responsible for child abuse.
The failure to prosecute has come as a great blow to the victims who will now never see justice. We cannot accept the Attorney General taking to himself the powers to be judge and jury – as well as prosecutor. We believe that it is in the public’s interest that the guilt or innocence of an accused person should be decided by an impartial court – not one person, such as the Attorney General, making the decision - behind closed doors - in his office.
But as we have learned more, spoken with other people, examined the issues in greater detail, and shared experiences – we have come to the conclusion that the administration of justice in Jersey – as presently structured and run – has far greater failings than those which are apparent in the child protection issues.
It is difficult to escape the conclusion that the entire administration of justice in Jersey is defective.
Which is why we have decided that the protest this Saturday will be the beginning of a campaign for the good, affordable and objective administration of justice in Jersey.
Justice for all.
We invite anyone who has personal experiences of the inadequacies of justice in Jersey – in whatever context – to join us this Saturday – where we will begin a campaign for the fair, affordable and impartial rule of law.
We will march to the Royal Square, where one of the protest organisers, Carrie Modral, will address the gathering.
Also saying a few words will be Senator Stuart Syvret – who fully supports our campaign.

I for one will be there ! ths island is run buy clowns , who care about nothing but money and covering each others back, our law system is a complete utter joke, do u ever see a lawyer here in jersey suing another lawyer for wrong doing, i had a freind who done alot of work at a well known lawyers house! the lawyer wouldnt pay up and came out with many excuses, the lawyer told my freind to sue him , what a joke. these lawyers are just money making machines who look down on the working classes, they think they are better then us, well chaps think again uve been sussed

This island is run by fear. The electorate are in fear of the elected and this needs to change.
Until people start taking to the streets, and the ballot box nothing will change.
I hope those who are in fear of turning up on Saturday might just decide to show just a fraction of the courage that has been shown by the victims of abuse and be there to support them.
A Blind Eye
That ordinary people who are survivors have only one openly, vocally supportive States Member is a deplorable state of affairs. It is up to us, the ordinary members of the public to show all the support we can to this protest and let the 'justice' system know that we are behind these people, and also the more people that attend will surely give them the strength and courage to carry on their fight.
It has been quite sickening the amount of coverage the RAG has given to the ex-Bailiff this week. The editorial was cringeworthy enough, but to give, not just column inches, but pages day after day is NOT what readers of this paper want. The man in the street is not remotely interested in this man, as indeed he was not interested in us. Give us real news, honest news, investigative reporting. I see you have not afforded any of the victims awaiting justice any chance of an interview.
Finally, off tack, the BBC article on the de-criminalisation of all drugs in Portugal is a very interesting one, and something I have advocated for a long time. An experiment in Brighton along similar lines took place some years ago, and the effects were positive. Crime was reduced, and the police and medical professions were impressed with the results. However, I will not bore with the advantages as it would take a brave Government to consider such a move and that is certainly not what we have here.
Saddened at the result of the vote on your proposition yesterday, but should we be surprised anymore?!
Please, please let's see a good turn out on Saturday. Every single person will make a big difference.

I hear what you say in your blog however what you fail to comprehend is that 'people power' in Jersey has not arrived.
There was a brief glimmer of hope with regards to the 'Say NO to GST' protest again a spark when Time 4 Change arranged a meeting in the square. Daphne Minihane has also to be congratulated for trying to engage the public in various public displays of anger on behalf of the elderly of the island..............Mike Stentiford is presently engaged in a Save Our Coastline demo involving a human chain stretching from La Braye to L'Etacq....and then there is the 4th July March....
The March is a step in the right direction however I would prefer to see change come about through social policy and political engagement and therefore I am disappointed that the Peoples Charter seems to have died a death.
I will be supporting you all in spirit. I wish you luck - Jersey needs massive change!
It is very disheartening that one of the most vociferous contributors to this blog can not find the wherewithal to attend the demonstration on Saturday.
I am coming over on Friday, especially for this purpose. I have a hotel room reserved, and I plan to leave on Sunday - if I am not arrested in the meantime!
People Power in Jersey HAS arrived - it's just taking a while to sink in, that's all.
People have been crushed for so long that they have not discovered their power and voices yet.
Have you ever watched the hatching of a butterfly? They are born with their beautiful new wings all crushed and scrunched up - they have to let the sun warm their wings and let the energy flow into them before they can use them.
So don't get disheartened - keep steadily on, it's NOT a waste of time. We are waking other people up, they know we're telling the truth.

Former bailiff stands by speech -
Jersey's former bailiff has said he was justified giving a speech on Liberation Day 2008 about a child abuse inquiry.
In 2008 Sir Philip Bailhache said the real scandal was what had been written and said about Jersey since the investigation was made public.
Sir Philip, who retired on Tuesday after 15 years in the post, was criticised for the speech.
But Sir Philip said he stood by his speech and thanked States Members for their support, company and friendship.
Sounds like Stuart's opinion of him is entirely justified then!
You are not kidding I have, justice in Jersey just doesn't exist! I know that many people in the island who have suffered at the hands of the Jersey Way that I cannot actually count them!

A note to the organisers of this protest.
You better hope that 2 days notice, for a protest that has completely altered and expanded its remit overnight, held on a day when many of the people who would be interested in attending are at work, does the job.
This island has a history of apathy when it comes to public political events. You NEED to take the time to MOTIVATE people to attend an event like this.
At the very least you should have made your big announcement a week ago, then spent the rest of the week promoting it online and off, getting it into the public conciousness.
And you should have held it on a Sunday, for maximum possible attendance.
In future you HAVE to start going about it the right way when it comes to promoting protests of this nature. Please. This protest is too serious to be allowed to fade away or be ignored as a damp squib event with a couple of hundred attendees.
Next time, THINK AHEAD.

It's interesting to note that since Heroin was decriminalised in Portugal, importation from that country to Jersey by Portuguese nationals has radically increased.

This protest has been planned and promoted for quite some time now with flyers being distributed and information on VFC and other sites including this one.
As for holding it on a Sunday, it would not really be feasible because there is not point walking through an empty St Helier with no members of the public 'en route' to take note of what the protest is about.
It is a very sad reflection that this protest has to take place in any event, because justice should have been the right of these survivors of abuse. However, if the public really feel strongly enough they will make the EFFORT to take one hour out of their day regardless of how little notice has been given, but rest assured it has been planned and notified for some weeks now.
PLEASE BE THERE!
I agree with Karen re the apathy to public protest here in Jersey. However I suggest that as Jersey rapidly runs out of money and our political system is exposed for the sham it is....as middle Jersey falls into debt and as income tax rises for the few and higher GST is implemented - or however Philip Ozouf wishes to title his grab on our hard earned cash....the people might just start to take notice of what a crap system we have had over the years...............
Lets face it the horrors of the child care system in Jersey or gross malpractice at the hospital hasn't got the majority motivated, it will take a cash grab one better than GST to get people off their backsides and out on to teh streets.

The best protest would be to arrange some event that people would like to attend anyway, like a mass picnic in People's Park or beach BBQ at West Park - even better if some musicians could be found to support it and entertain the crowds. Give the people more than one good reason to attend and the turnout would be much better.
All it needs is for a good excuse to do something they'd like to do anyway, and people will enjoy the protest at the same time as making their point.
I've just watched the local TV news and saw with horror that they're planning to chop down some mature healthy oak trees at People's Park just because of some poisonous caterpillars - surely there must be a better solution?
Even if they only chop the affected branches off and 'pollard' the trees, that's better than felling them surely? PLEASE SAVE THE TREES!

I don't really need that sort of criticism thank you - it's bad enough not being physically able to get to Jersey, let alone having my nose rubbed in it.

Unless I have interpreted it wrong - in cases of 'emergency' the Lieutenant Governor can use his 'negative' voice to make a governing decision.....

That part of the Code of 1771 has been superceded.
The LG's direct veto was removed by the States of Jersey Law 2005; though it was only ever a power used in proxy in the name of the Crown.
The fundimental power of the Crown - exercised through Her Majesty's Government - remains.

A lot of us are quite vocal on this blog but that does not mean if we can't be there we can't support the march tomorrow in other ways. Some of us who no longer live in Jersey are disabled, pensioners and otherwise on low or fixed incomes. A weekend in Jersey would be wonderful for most of us and a chance to meet virtual friends but some of us do not have the "wherewithal". Zoompad is making a video. I am holding a canlelit vigil from 12 noon with a number of friends as I have done before. I believe all support is valid - not just being able to be there.
I have emailed Carrie to tell her I cannot come as it is my retirement weekend and I can hardly miss my own party!
I will be on the next march God willing.

I think it's only natural that people are going to look up to you, Stuart, after all you've done. I certainly do, anyway, I think you are brilliant.
There's this other man who has giving me courage and inspiration, he is an 83 year old medalled hero called Norman Scarth. He stood in the 2007 local elections at Sedgefield - Tony B. Liar's seat - that's why he did it, as a form of protest. He fought against the Nazis, and he's still frighting now - he is an amazing man, you ought to read his story. He's the oldest human rights-stand up for the little guy campaigner that I know of - not only that he's got a massive sense of humour as well.
He's certainly given me inspiration and fire, anyway!
So I think it is alright to respect and admire other people - just as long as you understand what you are respecting and admiring them for. Courage and selflessness is always to be admired.
But those toads who mince around in fancy dress, pretending to be ghosts of the 17th century, or whatever they think they are - great poncing idiots by the look of it - why should they have respect if they bully other people and break all the rules of civilised society every five minuits? They don't deserve any respect - just ridicule and contempt.

If anyone else could do with a bit of inspiration here is a video I made about a letter Norman recieved, after his complaint to the Office for Judicial Complaints, about a Bradford QC acting as Election Commissioner called him many nasty names, such as, "a paranoid, disturbed, violent & crazed old man” and a “sordid public nuisance”, which seems to be a very disrespectful way to treat a man who is not only a five times medalled hero, but a brave and public spirited gentleman to boot. Not that it bothered our Norman, after all, he's fought against the Nazis!
Anyway, I've put it on my blog now.

As I write, I hope the protest is well supported. However, there are probably many more people like me, too paranoid to participate for fear of loosing a job, promotion, planning application,etc.

This is exactly what we have to set out to change here. Please do not be afraid, you can hide away in the middle of the crowd, which will get bigger and bigger when people realise what the whole thing is about.
The momentum will be kept alive now, and there was a lot of support and encouragement from the general public who were bystanders which was heartening.

The protest was very successful today.
Over 100 people turned-out - a very large number for a sunny Saturday afternoon in very conservative Jersey - where people aren't predisposed to engage in public protests.
People also are beginning to show recognition of the fact that - as bad as the issue is - it is not only child protection failures we need to be getting angry about; the entire administration of justice in Jersey is inaccessible, incompetent, non-ECHR compliant, grotesquely expensive, biased and dysfunctional.
Factors which affect everyone in Jersey.
There were banners, placards, a stilt-walker, balloons - and a good, healthy degree of chanting.
Protesters felt they had tried the quiet approach last time - and garnered only the predictable contempt from Jersey's oligarchy.
So this time there was some good, vocal sloganeering.
Carrie and the other organisers did a fantastic job.
I also detected - which is quite sad - a regrowing of the suspicion and contempt for the police many ordinary people have had over the years.
There were a few cops accompanying the demo - as you would expect - and one of these gentlemen attracted a few good-natured "Who ate all the pies" comments - not that I approve of such observations - not least because, these days, I'm hardly in any position to criticise the more full-figured members of our society.
But both during the demo - and in conversations with other people afterwards - the issue of the cops and their attitude was discussed.
There has obviously been a big battle waged by Graham Power and Lenny Harper against the traditional 'bent' side of Jersey's police force - many of whom are responsible for concealing child abuse, failing to take it seriously, and generally engaging in corrupt activities.
However - Lenny retired - and Graham was sabotaged and suspended by the Jersey oligarchy - people like Bill Ogley - who is actually under investigation for perverting the course of justice and misconduct in a public office.
So the Jersey police force - under the "new management" of Weirdcop & Co. - seems to be rapidly reverting to "business as usual".
A question which was asked of me was "do you think that these cops - when they joined the force - imagined their task, their orders, would be to obey people like Barking Bill Bailhache - and help him and his oligarchy friends conceal child abuse - and instead be doing things like arresting and turning-over a politician who was attempting to expose child abuse and mass-murder?"
My answer?
I said "sadly, I get the strong impression that most of them couldn't give a monkey's - and as far as they're concerned - it's just a another job."

A man, who like yourself was never afraid to speak and be heard. A man who like you was rediculed and thwarted by the establishment, is this not better than not achieving anything at all.
Being articulate, passionate relating to Justice, green issues with principles and values no matter how unpopular they are - you provoke debate and continue to raise serious questions which you have done throughout your career.

No I am not putting you on a pedestal suggesting you are a Saint, contrary to popular belief on PJ. Sadly they cannot cope with anyone who shows intelligence - understanding for those less fortunate.
Like Tony Benn please continue to speak out, continue to challenge the establishment. Far better for the electorate - sadly it seems the majority of elected representatives in the States of Jersey, run with the hares, hunt with the hounds and then sit on the fence waiting for the carrots.

I was at the protest/rally today - which is hopefully the first of many organised to highlight the many issues and defects with the way law is applied and protected here in Jersey.
Whilst it is undoubtedly much easier NOT to give up one's own time to participate in such events, ultimately one has the option to either stick one's head in the proverbial sand, or, as some of us did during Saturday, stand up and be counted whilst fighting the good fight...
I loved the Deputy of Grouville's heartfelt appreciation of the departing Bailiff in the Grouville Gazette. Doesn't she agree with your "devil incarnate" theory about him then?

She is very much a person of her own mind. There are a number of issues we don't agree on.

While I fully understand the writer's intentions one has to ask whether Jersey can afford many more civil service suspensions?
At the last count the taxpayers of Jersey were paying £990,000 a year for its employees' gardening leave - plus the cost of hiring their temporary replaceents.

Remarkably few - if any.
All great protest movements have small beginnings. Yesterday was just such a beginning - and a very successful and important beginning - in that it brought together people who would not usually have recognised that the problems they face are shared by different categories of people.
It was also another illustration of that power which terrifies the Jersey oligarchy above all others - people getting organised and campaigning as a team.
Yesterday's protest was very successful - a successful beginning.

For supporters/sympathisers of this blog this is a serious shortcoming on the part of Britain's major news source for overseas web surfers.

small item on Channel TV's website - I hope there's a longer piece on Monday's Channel Report.
It's a shame when weekend events get crammed into small weekend bulletins on at odd times that hardly anyone gets to see. A weekday protest might actually make it to a Channel Report that people actually watch.
So far it has been all the wrong suspensions that have taken place. Therefore if Ogley is suspended this means things that should happen are starting to happen, and dont worry they have Richardson lined up for Ogley's position, also dont worry about Ogleys perminant gardening leave,he will be doing it, hopefully in England.

Once there was a time in your life when you didn't know how to walk. Once there was a time in your life when you didn't know how to type. Once there was a time in your life when you wouldn't have been able to read this because you didn't know how to read.
And today you can do all three of those things without thinking. You take for granted what they help you achieve on a daily basis. Yeah?
Yesterday at the protest the people took their first steps in the journey of change. Get used to it, because as time goes by they will only walk stronger and walk further.

Stuart, can you please answer why your attendance has started to slip again?
My attendance has "started to slip" - because I have pressing work to do - such as trying to prevent an abuse survivor having a nervous breakdown - as the States trample on their benefits rights - already having destroyed their lives generally.
I am working on structuring some kind of legal support and campaign for survivors - none of which is resourced at present.
I'm working with people on a variety of issues to challenge the utter stagnation of Jersey's public administration.
I'm having to spend time such as have a 1.00 hour conversation with a young man plainly in danger of attempting to take his own life.
I'm busy applying thought, effort and research into important subjects - which I will bring to the States for debate in due course.
I'm afraid your gullibility for the misuse and abuse of statistics doesn't say a great deal for your intellectual grasp of issues.
Members voting records in the States should be adjudged on the question of 'quality' - as opposed to 'quantity'.
I guess I too could be the kind of States member you prefer - and sit there slumbering uselessly whilst a dozen recorded votes are taken on matters frequently trivial.
But, I'm not.
I prefer to be putting my time, work-capacity and energy into doing something useful for my constituents - as opposed to sitting there as a piece of passive lobby-fodder.
You're entitled to your judgments - so if you prefer to be represented by passive, political non-entities - then that, no doubt - is how you will vote.

And may I ask Anonymous did you attend? Do you believe in what this protests and others are all about? Do you sit complacently and comfortably at home saying 'I'm all right Jack, so sod anybody else?'
I guess the answer to all these questions would probably be no. However if I am wrong and the answer is yes, why be so negative, give support and wonder why such protests have to take place in the first place.
Believe you me, there were people there who a year ago would not have dreamt that they would be marching through the streets of St Helier, myself included - so, that in itself is an achievement, not withstanding there were more attendees than at the previous White March earlier this year, and there will be even more at the next one.
So, this is just the start. Please do not knock people trying to get justice and fight for a better Jersey, it does you no favours.
Always remember Rome wasn't built in a day.

QUESTIONS FOR ADRIAN WALSH.
Why has there been *six* weeks of silence since you announced Planet Jersey was going to be checked by CID and Data Protection officers to prove the safety of the site and members private information from abuse or hacking "over the next week"?
Beirng in mind that announcement, why did you last week allow a known malicous troll onto your forum, whom its been alleged traced his victims by hacking private data?
I'm *very* uncomfortable with a website owner or administrator allowing someone like that to be active on their site. How can you be comfortable allowing it knowing the *obvious* risk it poses to Planet Jersey and your members?
What is going on? Answers please.
You will never get answers from Adrian Walsh as I think he believes the real trolls are posting on this blog and are therefore thrown off Planet Jersey. Besides there is ONLY ONE PERSON who is in court for internet abuse.
