In yet another amazing example of fearless and public-spirited ingenuity on the part of my moles, the Quite Vile Blog has been able to obtain the detailed minutes from a meeting of the Gold Command group, who are leading and co-ordinating the Jersey oligarchy’s strategy to destroy me – and thus salvage Michael Birt’s Knighthood.
But – before we examine a section of this unique and fascinating insight into the innermost workings of the Jersey oligarchy and their ‘Friends at Court at Whitehall’ – notice of some forthcoming postings.
As remarked in a comment, I had deliberately not written about the States debate on the question of whether to establish a Public Inquiry into the management of the Health & Social Services Department. I took the view we would just wait – and see.
Sure enough – the proposal was rejected.
A result so immoral and imbecilic, that you’d have had a hard time getting a room full of Palermo Councillors to support it – even if each of them was blindfolded, handcuffed, and had a Beretta to the side of their heads.
So – later in this coming week, hopefully - after the Hansard of the debate is fully available – we’ll be taking a very – very - close look at this latest act of self-inflicted disrepute by the States of Jersey.
Also – when time permits, I’m writing a letter to the Jersey Evening Post in response to the predictable mish-mash of disinformation, diversion, lacunae and lies we have so come to expect from Jersey’s only “newspaper” – The Rag.
They won’t print it of course – so in due course - it will be posted here.
Further – in the course of preparing the legal papers for serving upon the Justice Secretary, Jack Straw, I’m obviously writing a detailed account of my case, the facts involved, how and why things have reached this state of affairs – and the various gross abuses of the policing and judicial procedures we see being engaged in by the Jersey oligarchy.
As readers have asked for a straight, and easily understandable description of the situation - because people aren’t getting such facts from any of the Jersey media - I will abstract the key points from the legal case, and post it as a guide to the situation.
I guess, that will be around next week some time.
But – before then – contemplate the very latest exclusive scoop from the Channel Islands’ leading news source.
You know – I know – we all know – none of the Channels Islands' traditional media – especially BBC Jersey - would report any of this material; real news and dynamite scoops not, apparently, being of interest to Jersey news editors.
So here – in yet another apocalyptic exclusive for the Quite Vile Blog – I reproduce the first few items from the leaked minutes.
There is simply too much of it to publish in one go, so during the next week, readers will be able to ponder the remaining sections.
But – to be going on with – here is Part 1 of our exclusive.

OPERATION SALVAGE MICK BIRT’S KNIGHTHOOD

MULTI-DISCIPLINARY GOLD COMMAND MEETING

1: The minutes of the previous meeting were agreed as a correct record, and duly signed by William Bailhache (WB).
2: Consideration of mission statement.
William Bailhache (WB) began by reminding members of Team-Operation Salvage Mick Birt's Knighthood (OSMBK) that the exercise had grown out of the Program for Limiting Effective Plebeians (PLEBs) which had been initiated by several of the current members of OSMBK, following Syvret's success in the 2005 general election.
WB stated that the present exercise constituted the third attempt to oppress Syvret since PLEBs had been initiated. The first attempt to neutralise Syvret followed his writing of a satirical open letter. However, that attempt had been abandoned when it was realised most members of the public regraded the letter as an accurate and amusing depiction of power in Jersey.
The second attempt had proven more effective, in that it did succeed in removing Syvret from Ministerial Office, but this had only been viable because Syvret had been foolish enough to discover that the senior management of his department had very badly failed in respect of child protection. Obviously, this serious tactical error on Syvret's part, of expecting them to be carrying out their jobs effectively, resulted in the entire top-tier of the island's civil service uniting against him.
WB continued, however this was only a partial success as Syvret continued to be a significant threat to the oligarchy's hegemony, and, in particular his activities were making it extremely difficult to maintain the Culture of Concealment, with particular regard to the child abuse.
WB reminded those present that Team-OSMBK had been formed when events took on an altogether more serious and urgent nature. This had occurred when Syvret had published on his blog, in March of this year, a 1999 police report he had obtained.
The report revealed that a male nurse appeared to have murdered 13 frail elderly people during a two-month period on Corbiere ward of the hospital, during 1999. The investigation had not been effectively pursued, for the customary reason, and it had been felt at the time there was no need to inform the relatives of the deceased of the strong likelihood their loved ones had been murdered.
However, whilst somewhat embarrassing, by far the most significant and problematic aspect of Syvret's publication was that it suggested that the then Attorney General, Michael Birt (MB) was, in some way, accountable for the discontinuation of the murder investigation.
The custom and practice of traditional Jersey oligarchy Attorneys General had always been to minimise prosecutions for serious crimes, when such prosecutions would be damaging, or in some other way, problematic, for the establishment. MB had, when Attorney General, followed this standard procedure.
However, MB had had the misfortune to have had at least four of his “not in the public interest” non-prosecution decisions resurrected; co-incidentally, all by Syvret.
The four non-prosecutions in question being: -
(a) Not prosecuting the States of Jersey for the criminal act of dumping hundreds of thousands of tonnes of highly toxic municipal incinerator ash into the sea-porous land reclamation sites around St. Heller.
(b) Abandoning the prosecution of Jane and Alan McGuire, even though they had spent over a decade committing monstrous acts of child abuse against orphans.
(c ) Not prosecuting Jack Hydes, Frances Hamon, John Le Breton and Piers Baker for conspiracy to pervert the course of justice, and for concealing child abuse.
(d) Not prosecuting nurse M for multiple prima facie counts of murder against frail, elderly people. This case appeared particularly problematic for MB, given he had played a role in the group decision made on the 20th May, 1999, to the effect that the families of the relevant patients wouldn't be told or interviewed in phase 1 of the investigation. It was also recognised as especially problematic for MB that, although Nurse M had been remanded in custody for a number of other, serious charges, MB, as Attorney General had decided to not oppose bail, so Nurse M was released from custody, two days after the launch of an investigation, based upon powerful prima facie evidence, that Nurse M was, in fact, a serial-killer.
WB informed the meeting that whilst tremendous latitude was given in such matters by the Friends at Court at Whitehall (FACAWs), it had been felt that the customary and automatic granting of a Knighthood to MB may be hampered somewhat by such 'clouds of controversy' hanging over him.
Whilst no indication had been given that this problem would influence the conferring of the Knighthood, it had been agreed that it was better to be certain, and thus seek to exculpate MB before Christmas 2009.
It had, of course, been recognised that the salvaging of MB's knighthood had a double advantage in that it would also produce, as a consequence, another opportunity give effect to the objectives of Operation PLEBs, namely destroying Syvret.
There had, therefore, been complete unanimity that OSMBK would be launched.
WB concluded that, a;though an all-out attempt to eliminate Syvret involving all arms of the state had been initiated, it was still proving surprisingly difficult to bring the exercise to a successful conclusion.
WB invited acting Chief of Police, David Warcup to provide the status up-date.
3: Status Up-date by DW.
David Warcup (DW) informed the meeting that Operation Salvage Mick Birt’s Knighthood (OSMBK) had suffered a serious set-back since the previous meeting.
He stated that Syvret had escaped from Jersey on Monday the 19th October, and that the escape had been effected two days before the pivotal judicio-prosecutory manoeuvre – namely the ruling that Syvret’s entire defence case – previously accepted as admissible for the preceding three months – be now deemed inadmissible.
This action – simply ruling the entire defence case inadmissible – would have secured a conviction for the Establishment.
However, Syvret had recognised this tactic, and had fled to London.
DW offered the assessment that SB and BS had, perhaps, revealed too much of the hand during the last directions hearing Syvret attended.
BS responded to this by saying no blame could be attached to her as she simply followed the instructions of SB, as the transcripts show, and asked why the police had not prevented Syvret from escaping?
DW responded, saying that, as has been previously noted by the group, Syvret was under 24 hour-a-day surveillance, and although MG was no longer based in Jersey, Mark Cane and Julia Jackson continued to oversee the monitoring of Syvret.
However, there were limits to what even DW and the SOJP could get away with. If Syvret had revealed any indication that he was leaving Jersey and not planning to return, the SOJP might have had some semblance of an excuse to arrest him at the airport.
But as Syvret had not discussed his plans via any electronic means of communication, and had purchased a return ticket for the Wednesday morning, effecting an arrest at attempted departure would have been legally problematic – even with the obviously available support from WB and MB.
DW continued, the SOJP had three non-uniformed officers present at the airport in connection with this operation, but that two of them were recognised by Syvret.
DW conceded that the actions of the officers – pointedly sitting at a table next to Syvret in the coffee shop in the departure hall, staring at him, and saying, “hello”, may not, with hindsight, have been an appropriate tactic, given it had long been plain that intimidation and other types of psychological warfare had zero affect on Syvret.
AXE agreed with this last observation, and said some serious thought would have to given to this subject when Team-OSMBK reached agenda item No. 6.
DW continued. Notwithstanding this encounter, CID in co-operation with Customs - were able to delay the flight departure for one hour, thus enabling a comprehensive search of Syvret’s hold baggage. It had been expected to reveal two lever-arch files containing copies of the 1999 evidence disclosed to Syvret. Though Syvret would have had a legitimate purpose in taking the evidence out of the island in connection with obtaining legal advice, it would, nevertheless, have furnished OSMBK with sufficient excuse to arrest on grounds that the spin-doctors could have then peddled as legitimate.
However, no such material was found in Syvret’s baggage, thus disposing of the last opportunity to effect arrest.
The standard fall-back procedure of planting a quantity of cocaine in his bag was considered, as would be expected, but it was felt that this might be too implausible, notwithstanding the ‘Special Latitude’ applying to OSMBK.
However, a further profound problem was revealed later that morning via surveillance. After Syvret’s departure, it became clear he had electronically scanned every single page of the disclosed evidence, and, before departing for the airport, had e-mailed the resultant quantity of PDFs to several secure e-mail addresses, to which only he has access.
DW accepted that the resultant loss of control of the data could well be a fatal turn of events for OSMBK. It was now recognised the 1999 evidence destroys the prosecution case against Syvret and secures a watertight public interest disclosure defence. But worse, in respect of the objectives of OSMBK, the evidence demonstrates a criminal investigation failure even greater than Syvret had previously suggested.
DW accepted that the surveillance operation could have been more alert, and spotted the e-mailing of the PDFs before Syvret was able to escape, thus enabling his arrest.
However, DW remained strongly of the view that the SOJP could not always be expected to recover the serious errors of other agencies involved in OSMBK.
He pointed out that the terminal error had been committed by the prosecution in first agreeing that Syvret had a right to run a public interest disclosure defence. Had the prosecution not done so, the 1999 evidence would never have been disclosed to Syvret in the first place.
Not only would an ‘inadmissibility’ instruction to BS have kept this profoundly damaging evidence out of Syvret’s hands, it would also have protected the prosecution and the court from the immensely high-risk and unprecedented gamble of attempting to turn back time, and have the public interest disclosure defence deemed inadmissible, three months into proceedings.
SB intervened at this point, and reminded Team-OSMBK that permitting Syvret to run a public interest disclosure defence had been agreed by all, as it was felt important for cosmetic reasons that some kind of defence argument was available to him.
KK agreed with this view, stating that the credibility of the proceedings had already been difficult enough to maintain, given Syvret had been denied access to the vast majority of evidence he required as disclosures for his defence, prevented by the court from calling all but two of the witnesses he sought, and denied adjournments – even though he was self-representing and without legal advice.
KK continued, if, at an earlier stage, Syvret had been denied a public interest disclosure defence, the proceedings against him would have had no public credibility at all.
It was explained that whilst this was not a problem within the Jersey media, there were limits to what could be maintained at a national media level – even with the very substantial bribery slush-fund made available for use on certain freelance “journalists” by OSMBK.
KK also pointed out that whilst the manipulated and forged e-mails used against the Historic Child Abuse Investigation had been very effective, that strategy had become perilously close to being exposed at a national level, and may still be so.
DW concluded his status up-date by informing Team-OSMBK that he was not now certain how events would play out from a police force perspective. Obviously, had events been confined to Jersey, the policing element would have been able to act as predicted.
But now that the Met had been pre-emptively approached by Syvret, and MPs who were supporting him, and had agreed a single point of contact, and had indicated that no enactment of a ‘backed’ arrest warrant would be undertaken without due legal process, the chances of recovering the situation via customary policing interventions were now extremely limited.
WB accepted the status report, but expressed serious dissatisfaction at the turn of events.
He explained that the normal constraints on policing activity did not apply in Jersey, generally – and that in a “Special Latitude” case, such as this, the police would have been legally secure in respect of virtually any action they had taken against Syvret, short of machine-gunning him to death in the airport departure lounge.
However, WB continued, even that action may have been legally secure given that Syvret possessed a copy of The Guardian in his bag, and is a member of Greenpeace, thus justifying an ‘extreme prejudice’ anti-terrorism intervention.

I have been riveted by the story of your departure (escape), although I sometimes found it difficult to separate an actual event (did they really delay the flight for an hour) from a facetious embellishment (do they stoop to planting drugs on political dissidents in Jersey - although these were very entertaining none the less).
I am intrigued that you didn't simply post several CDs/DVDs (for redundancy) with the data out of the island (given how many Play.com send) - or was it that your every move was being watched and that you couldn't get someone trustworthy to post it for you?
When it comes to such data transfer over the wires, would it not be easier just to use a gmail account (or several secure email accounts) and email the documents to your multiple email accounts via gmail, or just save it as a draft in gmail (inspired by the film Traitor). That way the encrypted SSL transfer wouldn't reveal the contents of the files being uploaded (particularly if you used an encrypted zip archive).
If you don't want to reveal how you really did it (and I wouldn't blame you) please feel free to moderate out this comment (or edit it to suit yourself).

But the general point still applies..In 2002 they published for gain my name and address and my tenants also , even though they were not recorded through the Royal Court so presumably electoral registers or rates were used also.

I met the frightened policeman at an isolated country restaurant, many miles from his home and station. Detective Constable Peter Cook had finally despaired, and decided to blow the whistle to a reporter.
He was risking his career, so made me scribble my notes into a tiny pad beneath the tablecloth.
He had uncovered a vicious child sex ring, with victims in both Britain and the Channel Islands, and he wanted me to get his information to police abuse specialists in London.

Incredibly, he claimed that his superiors had barred him from alerting them.
He feared a cover-up: many ring members were powerful and wealthy. But I did not think him paranoid: I specialised in exposing child abuse scandals and knew, from separate sources, of men apparently linked to this ring.
They included an aristocrat, clerics and a social services chief. Their friends included senior police officers.
Repeatedly, inquiries by junior detectives were closed down, so I, a journalist, was asked to convey confidential information from one police officer to others. It seemed surreal.
I duly met trusted contacts at the National Criminal-Intelligence Squad. That was more than 12 years ago, and little happened - until now.
Last weekend, a child's remains were found at a former children's home on Jersey amid claims of a paedophile ring.
More than 200 children who lived at Haut de la Garenne have described horrific sexual and physical torture dating back to the Sixties.
When I heard the news, my eyes filled with tears. I felt heartbroken, not least at my own powerlessness. I have known for more than 15 years about Channel Islands paedophiles victimising children in the British care system.
A reader asks - given I have confused the situation - whether I did - or did not - speak to Barry Faudemer about the Marolia case.
I'm not posting the actual comment, because of the extraneous abuse it contains, but I'm more than happy to clarify the situation.
I had said in a comment posted on the 20th March that I hadn't actually discussed the Marolia case with Mr. Faudemer.
That was a mistake on my part, as I did discuss it with him in a brief telephone call, in - I think - 2004 or 2005. I can't be sure of the date.
The mistake I made was thinking that that telephone conversation I had had, was with Andre Bonjour.
It wasn't - it was with Barry Faudemer.
However - that mistake has precisely zero bearing on the case.
Whether it was Barry Faudemer - or Andre Bonjour - the fact is, that contact was one of the occasions I tried to get the police to take the issue seriously again.
Incidelty, in the March comment, I said it was my "understanding" that BF was very unhappy at the plug being pulled on the investigation.
That assessment is strongly reinforced by the subsequent reading of the evidence from 1999.
I imagine BF reads this blog, if so, I advise him that the recent statements he has provided in respect of the prosecution against me are simply non-compatible with many of the evidenced, key points in the 1999 records.
I stress immediately - I am not for one instant suggesting bad faith or dishonesty on the part of BF; simply that - after 10 years - he has failed to recollect events accurately. How many people would after such a period of time?

Mr B Faudermar made a superb Police report, this was while he was employed as a States of Jersey Policeman and getting paid for it at tax payers expense.
He was doing his job to the best of his ability and doing very well.

Let us hope that he is not having a "memory loss" because he is being "got at".
Mr B Faudemer is a key instigator/witness and there is no getting away from it....

Wanting a prosecution system that prosecutes child rapists and serial killers, instead of politicians who are doing their job in trying to hold the executive to account.
But - no doubt - if your views continue to prevail - those systems may be a very, very long time coming.

Those on the island who think St Syvret's actions are about an alleged Data Protection breach and a licensing matter are either dense, or knowingly ignoring the realities which are so easily visible.
Those who stick their heads in a hole and post comments supporting a failing system are being profoundly unwise. If you support the present judicial system in Jersey then look at history to tell you what you might expect in future. All the tell tale signs that indicate you have a working dictatorship on Jersey are present. This matter has to be faced and the silence of so many residents who have decided not to rock the boat because "it does not affect me" are delusionary. This affects all residents of Jersey who wish to live in a democracy. Just take a look at history to see what happens when the process fails.
A very good friend of mine, a fourth or maybe fifth generation islander, who qualified as an establishment figure and with whom I was at school, left Jersey dismayed at the way the island is going. He said "it may always have been like it but I now belatedly realise it's like a poorly run private school. The administration can do what it wants because the teachers and the Governors are all mates who are hell bent on lining their own pockets. Add the veneer of British pomp and it presents a respectable face to outsiders. In truth we are being run by wide boys consumed by self-interest."
He may have a point.
I personally think he does, a good one, that more on Jersey ought to be aware of and willing to do something about. But inertia is so addictive.

THE CHIEF OFFICER OF THE STATES OF JERSEY POLICE HAS NOW BEEN SUSPENDED FROM DUTY FOR ONE YEAR.
Mr Graham Power QPM, Chief Officer of the States of Jersey Police was suspended from duty on 12th November 2008 by the former Minister for Home Affairs, Deputy Andrew Lewis.
It was originally claimed that the suspension was a result of a report relating to the Historic Abuse Enquiry which was prepared on 10th November and received by the Minister for Home Affairs on 11th November 2008. After almost a year of applications under the Code of Practice on Access to Information, the Chief Officer successfully secured a ruling that the Chief Minister should release details of when the suspension notice and related documents were actually created. This has revealed that the suspension notice was prepared on the morning of Saturday 8th November 2008 and therefore could not have been a consequence of the report received on 11th as has been claimed. To date Ministers have given no other reason for the suspension. It is not known whether it is in fact related to the Historic Abuse Enquiry or is for some other reason which has not been disclosed.
The fact that Ministers and others may have provided misleading information is currently subject to a complaint to the Privileges and Procedures Committee, the outcome of which is awaited.
Whatever the true reasons for the suspension, the following does not appear to be in dispute:
• The suspension is now a year old.
• No disciplinary charges have been brought.
• No hearing has been arranged.
• Costs to date are estimated to exceed half a million pounds and rising.
The Chief Officer is due to retire in 2010.

‘Walworth woman found with her face chewed by her puppy’

THE INQUEST into the death of a Walworth woman was adjourned yesterday, after her brother presented evidence that she was murdered, as a result of his investigation into child abuse in children's homes.
Dianne Maloney, 49, whose dead body was chewed by her ten week old puppy, was left in her flat for days after her death.
The sequence of events up to her death has left the family perplexed as to how she died, and why they have not been involved in any police investigation.
Speaking to the 'News' Bill Maloney, 52, the brother of the deceased, said: "There seems to be things that happened to my sister that they (the police) are not aware of. I was looking for an adjournment and I am now looking for an investigation by the police, because they have not come to me or come to my family."
In a short session at Southwark Coroners’ Court the coroner felt she had no option but to ask people to leave the court and look at the evidence presented by the family. However, when Mr Maloney refused to give further details unless they were in open court, the coroner postponed the case.
The 'News’ was told by the family that the puppy called Tenner was recently bought by Ms Maloney, who lived in Sutherland Square, and they had been verbally told by the coroner that it had been eating at her face.
However in the final report no reference was made to this, and as the same Coroner was not in attendance at the inquest they also felt they had no chance to examine the disparity in the situation.
The eight Maloney children, who lived at Astbury Road in Peckham, were all placed in care as youngsters. Mr Maloney said that Dianne had suffered long periods of sexual abuse while in homes, which resulted in her becoming a heavy drinker as an adult.
Following a tough upbringing himself, including physical abuse he suffered in care homes, he recently completed a documentary called 'Sun, Sea and Satan' regarding the Haut de la Garenne in Jersey where children's bones have been discovered in the grounds.
Dianne as a youngster took a sailing trip with the Sea Cadets to the controversial care home, which along with his own history in care inspired him to make the documentary.
He said: "I believe there is a conspiracy against me following the making of this film. Dianne had sorted herself out and was good but she was drinking again when her case (against two councils which was also looking into the treatment of children in care homes) was dropped, and the people who dropped the case knew this would happen.
"She was killed sometime between June 6 and June 12, on the 6th she attended King's College Hospital, where she complained she was punched in the chest, and there was blood around her mouth as well, but this was not followed up. My sister also had a habit of keeping thousands of pounds in her flat, which has never been recovered."
He added: "One of the last things she said to me was that she had a letter from the House of Commons she wanted to show me but I never got to see that. The next thing I heard was when I came back from work and my wife Maria greeted me along with my daughter Regan, and they told me that Dianne had died, so I could not understand why."
The police were contacted as the ‘News’ went to press but were unable to supply a response. A new date for an inquest has not yet been settled.

Yeah, it shows. IMHO.
I find myself thinking that its odd that the evidence was so overwhelming that it was necessary to suspend Mr Graham Power and yet 12 months later it is unclear as to why he was suspended!! and then my mind ponders whether it is being delayed for as long as it takes for Senator Syvret's case to be tried just in case some further evidence comes to light that could undermine any possible manufactured reasons for suspending Mr Power.
I am intrigued as to when did Nurse M change name, did this happen after March 2009 or before?

A nurse who was arrested on suspicion of poisoning two colleagues at a hospital in West Sussex will not be charged or cautioned, police have said.
Officers said the force had carried out a thorough investigation and there was insufficient evidence to charge anyone.
Reports of two alleged incidents involving pain relief drugs at Horsham Hospital were made earlier this year.
The 60-year-old woman remains suspended from work pending internal disciplinary proceedings by NHS West Sussex.
'No similar incidents'
A police spokesman said: "Sussex Police have worked closely with NHS West Sussex to conduct a thorough investigation into the allegations and decided there is insufficient evidence to charge anyone in connection with the complaints."
He added: "There were no reports of similar incidents being uncovered during the investigation and no suggestion that there was any risk of harm to patients or members of the public."
The nurse was due to answer bail this week.
The reported incidents were alleged to have taken place in May and July this year.
At the time, police said the arrest of the woman, who has not been named, was on suspicion of administering poison with intent to injure.

I'm not very impressed with your integrity in this case. You have not published my comment about the dubious logic of claiming that just because the suspension document was drawn up (a very few days) before the report was published, that somehow that implies definitely that the contents of the report had nothing to do with the suspension - a hidden hand argument. Shame on you.

Constable Simon Crowcroft gave us a frank interview regarding the suspension of Chief Police Officer Graham Power

To be logically fair, we cannot completely jump to this conclusion. Although the report may not have been officially released until the 10th (and seen by the Home Affairs Minister on the 11th) it is entirely possible, indeed probable, that the broad "bottom lines" could have been communicated to Home Affairs sometime prior to the 8th.
OK, so preparing the suspension letter before official sight of the report was pretty dumb (or efficient use of time - you choose) but it doesn't absolutely prove "hidden hand" reasons beyond what we can infer.
The report took months to come to the conclusion that Graham Power and Lenny Harper may have screwed up somewhat (not my own opinion here!). Shortly before the document had its final spell-check and was ring bound and posted, Home Affairs was unofficially told the bare bones of the conclusions and decided to make preparations to suspend Graham Power "as a neutral act" pending further investigation.
Of course, please don't take my "plausible denial" reasoning as being what actually did happen - it just could have - that's all.

As I'm frequently managing the blog from my mobile phone, I often find it hard to get through all comments in the correct order, or release them in time.
I endeavour to access the web from the phone only in wi-fi zones - in an attempt to minimise costs.
I can't always find such zones when I'm going to & from meetings, and even when I do, sometimes the connection is poor.
Anyway - turning to your comment - I'm afraid it misses the point, entirely.
The evidence uncovered by Graham shows that the then Minister, Council of Ministers, Ogley - and the current CoM have lied.
End of.
They have repeatedly asserted it was an emergency suspension - that had to be carried out - at virtually zero notice.
This is now proven to be utter rubbish.
Who wrote the report? Who commissioned it? What were its terms of reference? How long had it been in preparation? Why - even if such an extreme move as immediate suspension was deemed necessary - was Graham not given a copy of the report? Why was he not told of the purpose of the meeting he was called to? why did Ogley shred the contemporaneous notes - and why has Ogley lied about it ever since?
Why does the core political establishment of Jersey consist of a collection of proven liars, dissemblers and twisters of the law - who are able to get away with it all the time?
We may - in the coming months - get answers to some of those questions - given the degree of terminal hubristic overreach we have seen from the oligarchy this time.

Another fly in the ointment for those who say that Graham Power was suspended as a resut of an interim report by the Met team is that even by the 11th November, neither myself as senior investigating officer, nor the head of the ACPO Homicide Review Team who was reviewing my enquiry and quality controlling it, had been interviewed by the Met. When they did interview me in Scotland on the 17th November, I challenged them about the so called interim report. They clearly told me that no such report was in existence and that whatever Gradwell and Warcup were quoting from it was not a report of theirs. In any case, I demanded orally, by letter, and by e mail, that in view of the perception put out there by Gradwell and Warcup, that the Met should interview a number of witnesses who would clearly contradict what was being said by them. I was told by e mail that they would be in touch. I still have that e mail of course. They never have been and I know the report was delivered in December 2008. This of course leaves two possibilities. Firstly, there was no interim report as the Met said there was not. This means that the whole rationale for suspending Graham Power was a lie and that there have been some whoppers told by those claiming that he was suspended as a result of a non existent report. This would seem likey as the suspension report was typed even before the report was allegedly received. The other possibility of course is that the Met were lying. Of course if they were lying then it calls into question the credibility of any report which was completed before they had even interviewed the Senior Investigating Officer concerned and the Homicide Expert who had spent some months assessing the enquiry and reporting back on it. The whole thing stinks.

I see the states spinistics unit issued a true to form house price report headline this week. According to them house prices remain flat and of course all our media bought this nonsense.
Look at the detail in the report and you can see that everything apart from 3 bedroom houses has dropped by around 7% in the last 18 months. Certain types have lost £33k in value! Not the 1k which made a nice headline.
But hey ho, we couldn't have a headline of house prices plummet could we.
ACPO challenged them, I expect they are still waiting for a reply.
What a sad reflection on the States of Jersey, not only do they lie, they encourage others to lie for them. All at the cost of the tax payers.
Why the UK who have responsibility for good governence etc., have not stepped in is beyond me. No wonder they are always suggesting 'Independance' and looking into it. It is the worst thing that can happen to the Jersey Islanders although they may not think so.

Covering up child abuse
This week a heartrending story featured prominently in our local newspapers. This was the case of the girl who was allegedly raped by her uncle when she was just seven years old.
The story was particularly poignant for me because I have a daughter who is of that age, and believe me when I say that what is said to have happened to that little girl was the stuff out of which my worst nightmares are made.
As the story unfolded and the various witnesses took the stand, it became clear to me that if the accounts are true then this child was not only a victim of rape, but also of unforgivable behaviour by several members of her family.
Here we have a child who was molested by her grown-up uncle, who ends up ostracised by her entire family for speaking up about her ordeal. It appears that the grandparents, uncles, aunts and the entire extended family ganged up and rallied around the alleged perpetrator, while trying to bully the girl and her mother into dropping the charges.
If this is true, then action should be taken against them. They may not be guilty of the rape itself; however they are definitely guilty of emotional and psychological abuse.
Instead of love and support, this girl was made to feel that she was the cause of all the problems.

Mostly, I'm on your side. I wasn't disputing that there were shenanigans by Ogley et al - I was just pointing out a logical weakness in using the timing of a document's creation as a "smoking gun" to conclusively prove shady activity.
Since I commented, I have read Lenny's post on Team Voice (edit: also posted here a short while ago) which suggests that there wasn't actually any report at all to be presented on the 10th and received on the 11th. That changes things considerably. Go get 'em!
Ok so the s**t is going to hit the fan in the coming months and the oligarchy, past and present will be uncovered/made responsible for their lies, spin and cover ups.

If so, who wrote it and who has read it?

British-Irish Council meeting in Jersey
TAOISEACH BRIAN Cowen will be among the representatives of eight national and regional administrations from Britain and Ireland in attendance at the 13th summit meeting of the British-Irish Council, which takes place in Jersey today [Fri. 13th !].
Other politicians due to attend include former Northern Ireland secretary, and now secretary of state for Wales Peter Hain, representing the British government; Northern Ireland First Minister Peter Robinson; Deputy First Minister Martin McGuinness; Scottish first minister Alex Salmond; Welsh first minister Rhodri Morgan, attending his last summit in this capacity, and heads of administration from the Isle of Man, Guernsey and, of course, Jersey itself.
Surely an opportunity for some lobbying?

I agree.
I note there are those who offer no substantive argument as to why they do not believe the evidence already at hand. Therefore one has to assume they have either failed to research the issues and are unable to construct an educated view or they are 'part of the Jersey way ie: the FIRM' and are not interested in a logical debate or they are in fact children who have nothing better to do!!
Does anyone know whether Nurse xxxx, changed name prior to the publication of the secret report. If so it would seem the prosecutor's unrealistic 'new' argument could also have an additional flaw.

POLICE chief Graham Power should go because of the mishandling of the Haut de la Garenne case, according to Health Minister Ben Shenton.
Senator Shenton – who faced widespread criticism when he voiced suspicions that the murder inquiry was not justified back in March – said that Mr Power’s position had become untenable. And he added that yesterday’s announcement was clearly the real reason for the resignation of Home Affairs Minister Wendy Kinnard last month.
Yesterday, Mr Power was suspended from duty after newly appointed Home Affairs Minister Andrew Lewis said the investigation had not been handled correctly. He says that there will be an investigation into the conduct of the investigation and why the absence of any evidence about murders at the former children’s home was not revealed earlier.
And it has been revealed that Chief Minister Frank Walker has tried to gag States Members on the suspension. He sent all Members an e-mail yesterday which said that under usual suspension procedures, neither he nor Deputy Lewis would make any further comment on the matter, and he urged them to keep quiet too.
Both Senator Walker and Deputy Lewis will leave the States after the next States sitting. Under the Police Force (Jersey) Law, the suspension of the chief officer must be reported to the States at the next sitting. Any discussion of the suspension has to take place in secret, and under article 9(2) of the law Mr Power could be summarily dismissed.
The article says: ‘The Chief Officer may be suspended from office by the Minister which shall refer the matter to the States at their next sitting and may be dismissed from office by the States.’ Senator Shenton said that yesterday’s announcement by the police that they had concluded that no children were murdered there, that no blood was found and that most of the bone fragments found came from animals completely vindicated his earlier scepticism.
He said: ‘I believe that the position of Graham Power is untenable and I am surprised that he does not accept this fact.
‘At a time when important political questions needed to be answered he failed, in my opinion, to show the strength of character that was required. This weakness was shared by a Home Affairs Minister who was clearly out of her depth. What we now need is to achieve closure of this side of the investigation, be thankful that no murders of children took place, and ensure that those guilty of abuse are brought to justice.’
Asked about Senator Kinnard, he added: ‘This is the reason Wendy resigned, isn’t it? Because she got wind of the investigation. ‘Unfortunately, that is just the way I would expect her to react.’ The Senator says that he was criticised when he raised concerns about the way the inquiry was being handled back in March. He told colleagues at the time that he had been told there was no body, but just a bone fragment ‘possibly thousands of years old’ and that the investigation had been blown out of proportion by the police.
Senator Shenton says that he was threatened with legal action by former deputy police chief Lenny Harper over his comments, and that both he and his wife received abusive e-mails from around the world. He also says that he was warned off by Chief Minister Frank Walker – who told him that any approaches to the police or public statements on the case would be regarded by them as interference, and would be publicly disclosed. Senator Walker said that any minister who asked such questions would be in an untenable position and anyone ‘who may be responsible directly or indirectly for any suggestion of interference, will be on his/her own and will be exposed as such’.

I have published a very substantial number of comments that criticise my decision to name the individual concerned.
Conviction and punishment are administered by juries, courts and judges.
I am not a jurist, nor a judge. I cannot convict, nor punish anyone.
My role in this is the accuser.
If we had a functional criminal justice system – not least an effective, non-politicised prosecution system - cases such as this would have been dealt with correctly.
It wasn’t – so – in the final analysis, it fell to me to expose it.
Why do so?
The overriding objective was – precisely – to get Nurse M named.
So that the danger he represents becomes known – so that frail elderly people – and others – get protected from him.
Publishing the report – but not identifying him – would have been a near-pointless exercise.
Had my motives been as some have suggested – merely a political dig at the Offices of Attorney General, Bailiff, etc – then by far the easiest thing for me to have done would have been to publish the report without the name.
That would have had the effect of causing far less trouble for me – and quite probably, a good deal of speculation and questions that would have been troubling to the Crown Officers.
Meanwhile Nurse M would have continued to get the occasional job working night-shifts in private sector nursing homes.
So how do I feel about naming him now?
I wrestled with the subject far too long. I really should have done it years ago.
Why wasn’t he dealt with by the “wheels of justice” in Jersey?
For exactly the same reason as all the other major crimes – decades of child abuse, for example – haven’t been prosecuted. To have taken them to court would have been profoundly damaging and problematic to the States of Jersey. Not only would many, many millions of pounds in compensation have to be paid – but, in the oligarchy’s eyes, worse – the “image” of public administration in Jersey would have been annihilated.
Which brings me to a question I find most disturbing. Deeply so.
I’m asked “where are the relations of the 13 dead – are they keeping schtum too?”
They don’t know.
Do you understand that?
They were never told.
And the Jersey establishment are terrified of them finding out.
Is the report I published mistaken? Is he innocent?
No.
I – and several highly expert professionals have now examined in great detail the 1999 investigation evidence.
He did it.
If Nurse M reads this, I say this: – I suggest you confess. You know you did it. You know that any competent analysis of all the evidence shows that you did it.
You claim to now be a civilised human being? Then let the families know the truth.
Those 13 – and all the others, too.
Not just those in the General Hospital – but the private sector nursing homes – and those in the UK.
Finally coming clean about it – is your only chance at some kind of redemption.

What astonishes me is that Nurse M is still on the Nursing & Midwifery Council's register.
This means that he is legally entitled to practise as a nurse.
He is probably working in a hospital near YOU.

Well, seeing that those pieces of evidence found at the scene, the bones and teeth and other forensic evidence were never properly scientifically examined, as they should have been, it's truly astonishing that they weren't, the conclusion that no murder took place at Haut de la Garenne is completly without substance.
How peculiar that in some situations the Jersey Police throw themselves into minute examination of all the intricate details, nothing is too much trouble, such as, for example, the arrest and prosecution of Senator Stuart Syvret, for what some people might say is a very minor offence. And yet, these very same policemen, when faced with a case which may well turn out to be the horrific and brutal murder of a number of little children, shy away from proper examination and make clonking great errors in the way they treat the evidence uncovered.
I hope that someone from Jersey Police, not one of those who has been maliciously suspended or retired though, will explain this puzzle to me. I really would like to know the answer to this puzzle, we all would.

While I do feel empathy with this man's wife I cannot agree that if this man is suicidal it may be more about fear of the future and (possibly even) remorse for his actions. Stuart has not named this man without very strong evidence. As for the relatives of those who have died - maybe they have been kept in the dark like the rest of us.
If someone takes their own life it is their choice and not the fault of another person. I could not practice as a counsellor if I felt responsible for the suicidal feelings or the suicide of my clients. I have to work with them to take reponsibility for their own feelings and actions. So far I have not lost a client to suicide but it has happened to colleages and I am prepared should it happen in the future

We all make honest mistakes of judgement at times, we are only human. I made one when I advised you not to go into hiding, to go through the Jersey court system, Stuart. I was wrong, you would not have got justice, and you might have been in a bad mess had you took my advice.
I have just had a letter from a man from Bradford called Norman Scarth, a very brave man who fought in WW2, who was awarded 5 medals for valour due to his services to his country. He is the bravest man I have ever known. He is 84 years old and STILL fighting, not with guns and bullets this time, but with letters and by standing up for election at Sedgefield. His friend Andy McCardle was (I had better put allegedly here) murdered for exposing Strathclyde Police’s involvement with the drugs trade. He was put into a psychiatric hospital, where he had an “accident”, Norman has pasted up pictures on his website of his friend lying in his coffin, pointing out that the injuries sustained do not fit the official verdict of how he died.
Norman was rewarded for his services to this country by being persecuted by the police, and given a 10 year jail term for (allegedly) assaulting a bailiff who entered his home – he was in his 70’s when this (alleged) offence took place. Norman denies it. I know who I am inclined to believe. Norman is fighting right now for a man called Maurice Kirk,who used to be a flying vet, who is right now incarcerated in a Cardiff psychiatric hospital, after a disagreement with the police over police corruption. They are trying to force him to have psychotic treatment even though he is completly sane.
So you see, Stuart, after doing some thinking, I have decided that you were right to ignore my advice. May God bless you and keep you safe and well.
It was not Senator Syvret who brought the case of nurse M to the attention of the authority, it was The States of Jersey Police.
Senator Syvret dug it up to show the public, after the authority tried desperately to bury it.

The "JEP" yesterday published a rather pungently worded letter about the cost of justice in Jersey from Ian Kenny.
I offer it here because it is so apposite to the 'Syvret Affair', as someone described it at a cafe in the Royal Square this morning.
"PETER Michel was just let off his six years of imprisonment because he was tried unfairly in the Royal Court by a blatantly biased judge and the Jersey Court of Appeal refused his appeal, so he appealed to the Privy Council.
"The Privy Council agreed that he was guilty as hell, but the Royal Court trial was unfair and his conviction was quashed. The Jersey Court of Appeal knew it was unfair but didn’t allow the appeal.
"Now the Jersey Court of Appeal, having already upheld Mr Michel’s conviction, has to decide whether there will be a new trial to try and convict him again.
"Of course, this decision is a ‘damned if you do, damned if you don’t’ one because if the court doesn’t order a retrial, then Mr Michel gets off scot-free and can claim damages for wrongful conviction.
"If the court orders a new trial, then Mr Michel can head off to London and be in the company of Senator Stuart Syvret making similar arguments to those which he is making (though probably more credibly, having already faced justice in Jersey and been wrongfully convicted because the judge was biased and his appeal was denied.
"Some questions:
• How much did Mr Michel’s trial at first instance, appeal and subsequent appeal cost the Jersey taxpayer – £5m? £10m? £15m?
• Why did the Attorney General stand by and allow the trial to continue to its 30-day conclusion, then subsequently admit to the Privy Council that it was fundamentally flawed? Surely the Crown Advocate at the trial realised what was going on? Why didn’t he/she intervene?
• If a new trial is ordered, who relishes the prospect of Jersey having two fugitives from justice in London singing from the same song sheet and claiming that they can’t get a fair trial in Jersey?
• Given that Senator Syvret said in a recent CTV interview that his prosecution so far has cost the taxpayer £3m, what if he too ends up at the Privy Council and wins? How much more will that cost?
• How much did the Haut de la Garenne fiasco cost? £20m?
• How much did the Curtis Warren trial cost? £8m? Are the UK going to pay for it, given that the Serious Organised Crime Agency seemed to take credit for it in the media? Is the conviction safe? Is he going to appeal to the Privy Council too?
"We are only a small island and there is a recession/financial crisis, call it what you will. Health is being cut back. We can’t afford all of these expensive criminal justice cock-ups.

He did write a book called "Courage", I have it on my bookshelf - I got very excited when I read it. I really thought that we were going to get a good honest courageous Prime Minister, and a sweep out of all that is bad in this country.I know some people might think I am stupid, but I just thought that if he admired all those courageous people and had them as his role model then he must be a really amazing man. I feel a bit stupid now, about being so naive.

If you were innocent of these allegations, you would prosecute, I would prosecute, and I suspect so would a falsly accused nurse. More importantly, if there was any documentation to refute Stuart's claims about the public danger posed by the nurse, the States of Jersey would have hammered Stuart with that evidence by now.
Before they tried to bury the case of Nurse M.
To be safe, the least they could have done, in the publics interest was discreatly taken him off of The Nursing & Midwifery Council's Register.

There is no such Earthly thing as "EVIDENCE of murder NOT taking place" in that old poorly documented and administered care home. If they can go so far as to absurdly claim that they KNOW murder did NOT take place at HDLG, they must believe few islanders would demand scientific proof on anything at all.
One can only conclude they are quite willing to wholly ignore or hide any evidence to suit their desires.
Their lack of anything concrete upon which to base their claim that murder did NOT take place is simply further EVIDENCE of their supremely arrogant confidence the public will not question the details any further. All in the best interests of Jersey, of course.

Whether it was murder or not there is no EVIDENCE that there were no unexplained or unrecorded deaths of children in Haut De La Garenne. On the contrary there is evidence that children died in there but we do not know when, how or why because the evidence has been hidden, covered up, lost, "ripped up" or otherwise destroyed or ignored.
I and a number of former residents either know for sure or are pretty convinced that children died through suicide or as a result of "accidents" and those children have never had a death certificate or a funeral of any kind. What about the lime pits? What about the furnace? How can anyone just leave all these questions unanswered? Mind you if they are prepared to ignore the suffering of hundreds of abuse victims I suppose they can do that too.
When I was in HDLG I had no relatives on the island and nobody knew what was happening to me. Many children in there were in the same position and would not be missed. That is one reason I am "Proud Survivor". What about the ones who have not survived?

With all due respect to the poster who suggested that Stuart 'may yet have blood on his hands', I suggest he/she read this extract taken from the police report, produced long before Stuart felt the need to highlight this disturbing story.
'He later changed this story, in that he intended to kill himself with the medication, by marching down to the Cenotaph in military dress, where he would inject himself with a lethal dose of insulin and potassium chloride.'
This would indicate that Nurse M has already shown suicidal/ phsyciatric tendencies, and if this is the case now, he should be seeking the appropriate help and care, and you (the poster) who appear to know the family should be instrumental in getting him to seek this help and not blaming Stuart for all Nurse M's ills.
There are 'cries for help' and people with real intent. The decision to end ones life is that persons decision ALONE, and it is no-one else's responsibility.

I cannot believe that a major police investigation was hidden from the relatives of suspected murder victims. This was not a superficial inquiry, but according to the Prosecution there were umpteen police involved over several weeks. Relatives who visited the hospital or nursing homes would have been important witnesses. The police would have interviewed them along with the staff on the ward such as nurses and doctors. They would almost certainly have interviewed the suspect.
Therefore you must be mistaken when you say the relatives were not aware.

At least one of our Constables has very little to occupy his time.
Constable Dan Murphy - never a man to hide his light under a bushel - is doing just that.
He has told BBC Jersey news sleuths that "there should be stricter controls over the use of Chinese sky lanterns".
Constable Dan went on to tell the eager beavers from the local radio station that "The large lanterns are lit up and set off at outdoor parties and weddings.
"But there are fears about the environmental impact, the potential for lanterns to be confused with distress flares and their risk as a fire hazard".
Our Dan is investigating whether their release can be controlled under Jersey air navigation laws linked to the airport.
"It's like throwing a naked flame into the air", said Constable Dan Murphy.
Angela Mitchell, a dairy farmer, wants them banned.
She said: "On Bonfire Night I went outside and noticed a lot of lights up in the sky.
"The next day when I was checking on my animals I found all the remains of these lanterns littered over the farm.
"These are quite dangerous, they could go into our hay barn, or they could land on a cow".
Trevor Le Roux, the island's chief trading standards officer, told BBC Jersey: "The situation is that we don't have any legislation to try and ban the sale of these products.
"The nearest we would get would be with our consumer safety law, but at point of sale these Chinese lanterns are safe.
"They have instructions and comply with the legislation."
Constable Murphy said: "Apparently there have been quite a lot of ground fires this summer, which could have been caused by these lanterns coming in to land.
"It's like throwing a naked flame into the air.
"We don't want to be killjoys, but at the same time we can't have people being distressed."
Methinks that Constable Dan "The Man" Murphy had little to do when he contacted BBC Jersey news!
You do not need to make up stories like that when local government bumbles do all the work for you!
No, I am not mistaken.
The relatives of the 13 were never told.
They were never interviewed.
A significant number of the other nurses were not interviewed.
Not one, single, solitary one of the doctors who's patients were the suspected murder victims were interviewed.
Ask yourself a simple question:
Can any investigation into a serious crime be - even vaugly - regarded as a competent investigation - if it simply does not interview most of the central and important witnesses?
There is only one answer - 'no'.
Now do you understand why the Jersey authorities were suddenly reduced to such a state of panic as to attempt such desperate and unsustainable measures as to get my entire defence case deemed inadmissible?
They will attempt anything in their power to prevent the truth from emerging.
It is possible that some of the families may now - given my publication of the report and the resultant controversy - begin to be thinking about the times and dates their relatives died.
Should any person have a suspicion that their relatives may have been one of those killed, if they wish, they can contact me in confidence at st.syvret@gmail.com and I will explain the dates and timings to them.
I know that my publication of the report caused the police to inform one of the relatives, but only because one of the incidents - which involved his relative - was described in the 1999 report I published.
Again - I feel I must be fair here to the police officers directly working on the 1999 investigation. Whilst many questions exist concerning the competency of the police role in the investigation - they did, at least, want to fully pursue the investigation.
They were overruled.
The disturbing fact remains - unless it has been by happenstance, for example, coming across this blog, and thinking about the dates - the relatives will not know.
I repeat - they were never told.

Re murder at Haut de la Garonne:
I don’t suppose that many who read this blog are aware, that up until not so long ago, a child born in jersey and who was illegitimate was, under Jersey Law, not issued or entitled to a birth certificate!! Now ask yourself this question.
If there are no official records of a child ever existing in Jersey, how difficult would it be to kill that child and nobody ever knowing? I suppose that many illegitimate kids ended up in that place? It offers one possible explanation as to why children’s remains were found but, no records of missing children!

It's happened again and again, it's happening right now in the Stafford Hospital enquiry. I wanted to give evidence in that enquiry, as I was assaulted by staff at Stafford Hospital, and I have been denied the chance to do so.
Likewise, the Dr David Southall enquiry - again, the whole thing was hushed up, my daughter was born prematurly in that hospital three years before Southall went to work there, so I know what the standard of care was before Southall, well, there was no efford made to contact the parents of children who may have been brain damaged or even killed as a result of being under his "care". The whole thing was shovelled under the carpet.
How can people be happy when there is such alleged wrongdoing being routinely swept under the carpet? We all have to access healt care at some time, any one of us could fall victim to institutional abuse, turning a blind eye is NOT an option.
Come on Syvret! Out with it!! You are unmasked!!! You're playing Widow Twankey at The Palladium aren't you? Your dramatic escape over the Channel Islands Wall was a publicity stunt. Well done that man!

No 'reasonable man' could disagree with you Stuart.
Put another way, why would a 'reasonable man' investigating a possible multi-murder not interview most of the central and important witnesses?
They appear to be the actions of an 'unreasonable' man, a man with flawed motives.
Therefore, a 'reasonable man' would concur, that having had a 'unreasonable man' of higher power effectively engage in a cover-up, the only recourse left for the 'reasonable man' is to bring it to the public's attention, in the hope that pressure will be bought upon the 'unreasonable man' to ensure have the case fully investigated without hinderance!! and also make the public aware of a potentially dangerous person, much in the similar vain of someone placed on a sex offenders register.
'M' (as he was known in 1990) managed to alienate himself at his 'allday police recruit interview' by describing Jerseymen at the Battle of Jersey as cowards, further stating that the jersey flag should have a 'yellow' streak in it, and that the 'red' in the Jersey flag represented the blood that the Jersey soldiers never spilt!!,needless to say he failed the interview.
Following various excuses/reasons and a second interview the SoJP decided he was actually ok!...His start date was delayed because of the Gulf War...the rest is history.
If any phychological issues had been picked up by SoJP then SSS might not be in the situation he is in?
Could it be that the growing culture to pay public servants very high salaries, often attracts employees who could not command or be worthy of such a salary in a commercial company, which in turn, leads to more cover-ups by such staff who fear a dramatic salary decrease if removed from their job for incompetence?

I am shocked, is this true that illigitimate children born in Jersey were not registered. I find it unbelieveable. Even in Victorian England illigitimate children were registered and baptised. My great great grandfather was illigitimate, he was registered, had a birth certificate and was baptised.
If what you say is true how many children have gone missing in Jersey, how many war babies were not registered, it is beyond belief. Did they not appear on the census roll, are there not census records from the 60s for HDLG or have these been put in Ogleys Shredder.

Nurse M is plainly a deeply damaged and disturbed person, and as an earlier commenter remarked, I really hope those who are close to him are helping him finally face the reality of his problems, of what he’s become and the things he has done.
He needs help – and he needs to face-up to reality. I don’t believe he’s capable of doing that on his own.
It is suggested above that Nurse M may have suffered some great trauma – been a victim of crimes, such as child abuse, for example.
Yes – that is a possibility.
But in response I would make two observations.
Even if you’re a victim of foul crimes – such as being abused as a child – it doesn’t then confer some kind of right upon you to harm others in turn. On the contrary, those who have been victims of serious crimes should see all the clearer the futility and wrongness of harming others.
Secondly – and in specific reference to Nurse M – and claims he may make about his past, I’m afraid I must come back to the fact that Nurse M is a deeply troubled and deluded individual, with no clear grasp of where fact ends and fantasy begins.
I know this – because during his run-ins with the law in the late 1990s, he claimed – he used as an excuse – that as a result of dealing with bloody carnage when serving as an army nurse in the first gulf war in the early 1990s, he suffered from post-traumatic stress disorder.
This claim was sufficient to mislead a number of people into making allowances for him and his strange behaviours; not least the then nursing regulatory body, the UKCC.
His claim is fantasy. He served with a TA field hospital – which was based on the outskirts of Riyadh – absolutely nowhere near the fighting - and which saw no action whatsoever.
It is these kinds of immutable facts which are now catching up with Nurse M.
Which is why he needs help – and why he needs to start being honest.
If his harmful activities and fantasy-world are to be put behind him – if he does want to – indeed, if he’s capable of – shouldering the truth – he needs to come to terms with what he has done.
It’s time to go to the authorities and tell the truth.
Not least for the sake of the families.
In the final analysis – does Nurse M posses the necessary qualities?

Deputy Mike Higgins top ex civil servant and a man of deep social conscience is asking his fellow States members to open and enquiry led by an out side QC on operation BLAST.
Operation BLAST consisted of secret files being kept on Jersey politicians without their knowledge or consent? He will no doubt be asking, who instigated the operation carried out by the States police? What were their motives? And why were politicians not informed.
This scenario is not unlike J Edgar Hoover of the FBIs' secret dossiers held on American Senators and politicians years ago. The question surely must be that if any politician in the Jersey assembly votes no ………. why?

There is I beleive an ongoing investigation by SOJP into the circumstances of the original investigation. Nurse M and his family and friends will have to await the outcome of that.
If these heinous crimes did occur then one would hope that the colleagues that he worked with would come forward with any evidence, that the relatives would come forward and that forensic evidence may still be gathered.
Senator Syvret clearly disputes the diagnosis of PTSD so one assumes that he has seen a full CV for the gentleman in question. As SSS purports to want a fair judicial system may I suggest that this man is innocent until it is proved otherwise.
You have done your public duty as you see it by outing him but remember that you have chosen a life in the public eye this man and his family have not.

I am in awwe at the Australian Government's decision to apologise for their past errors concerning the taking of child immigrants from the UK, where they were either used as child labour on farms and in some cases also terribly abused.
I have nothing but praise for the Statesmanlike behaviour of Australian Prime Minister Kevin Rudd when giving this apology. Soon I believe a similar apology will be given by the British Government. A while to wait - in the spring of 2010 is it? Why so long?
Jersey Survivors and the relatives of the abused who are now no longer with us wait for an apology.
A valiant attempt at giving an apology to the survivors of abuse in Jersey was nearly given in a Christmas speech to the States of Jersey assembly, by the now exiled Senator Stuart Syvret who is the Father of the house. Sadly this speech was stopped by order of the 'President' (I know him as the Bailiff) of the States of Jersey.

Senator, I strongly agree with you. The families of any murder victims, and the unwitting survivors of any murder attempts, have a right to be informed. I am fed up hearing about Nurse M's human rights. Many of the staff in the hospital and the police have a good idea about what went on. Let's get it out into the open. Also let the AG drop this ridiculous and expensive case against you, and get you back attending the States.

The actions taken to stop Senator Syvret's speech was taken by a 'reasonable man'!!?. I think its actions of such stupidity that leaves the 'reasonable man' with no other recourse than going public on his blog, as obviously, the then Baliff, demonstrated that he was not prepared to listen to 'Father of the House' Senator Syvret.
Non action on serious issues, when Senator Syvret wanted a public inquiry on Health, he was illegally removed as head of the department, by the actions of 'unreasonable people' which means that having such experience the only option to a 'reasonable man' was to do what has been done. Also if I recall correctly, the JEP were given a copy of that report, but failed to address any it!!!
When 30 odd 'unreasonable people' vote against an inquiry as demonstrated recently, there is only one course of action a 'reasonable man' can take.
'For it must be true that the freer journalists are to criticise, scrutinise and analyse, the more trustworthy institutions become. That is because without freedom of the Press there is no real accountability to the public.'

Jersey Care Leavers want an apology
Jersey's Care Leavers Association is calling on the Island's government to formally apologise for past child abuse in state institutions.
Australian Prime Minister Kevin Rudd has announced today that his government acknowledges the pain and suffering of children who were abused in Australia fifty years ago. Similar apologies have been made by the Scottish and Irish governments.
The JCLA says the States should follow that lead and make a similar statement. The Association also wants more dialogue on compensation for the victims of child abuse, and an independent inquiry set up.
The JCLA say only then can the healing process begin.
I am getting a bit confused at all the fuss about files being kept on States members by the police without the knowledge of the subject of the files. Is it being suggested that where States members are suspected, for instance, of importing pornography, fraud, conspiracy to pervert the course of justice, and offences of dishonesty, that files should not be kept on them? Or should the police be telling the suspects that they are being investigated? Why should politicians be different to everyone else?
Something has really spurred me on to making a decision that I will only listen to BBC Radio Jersey to hear the States Debate and nothing more.
Reads like an episode of 'The Thick of It'. Just as sharp and equally amusing. One glaring difference though - This stuff really does happen in Jersey !

All you need to know, for the time being, is that I'm working hard, on several different aspects of 'the problem' - and if successful, the result will be wonderful for 90% of the population of Jersey.

You want functioning democracy? An objective and impartial judicial system? meaningful accountability amongst the senior civil service? A non-politicised prosecution system?
That's what I'm working towards.
The destruction of Jersey's corrupt and dangerous oligarchy.
Sure, it's a big task; after all, a stagnant ruling claque that's been in power for over 800 years won't be easy to remove.
But in the final analysis, there can be no more important task for a Jersey politician to be working on.
The oligarchy have placed themselves in a position in which even the "Friends at Court at Whitehall" - who love our rotten oligarchy, for mystifying reasons - are going to struggle propping-up the collection of crooks, spivs, child abusers, morons, serial rapists, blackmailers and assorted grifters who form our ruling elite.
But the FACAWs will not simply do the decent thing.
They love their Jersey shysters - so will have to be dragged every single inch of the way towards finally acting lawfully - and clearing out the cess-pit that is power in Jersey.

Police Chief Graham Power has now received the information previously denied him by Chief Minister Terry Le Sueur about the dates and times on which three letters he received about his suspensions were created.
Ex Deputy Andrew Lewis is quoted as saying: The earlier dates of creation simply reflect the preliminary work by the legal and HR advisers, which was contingency preparation in the event that the full disclosure of information by the Deputy Chief Officer might result in a decision to invoke the disciplinary code - this was sensible contingency planning, he said.
If it was such sensible contingency planning, why was Power denied it? He was even told that it did not exist!

When surgeons remove a cancerous tumour they have to make sure that get a good close look at the tumour before they begin.
This particular tumour has deep embedded roots that need to be dug out properly. It's a delicate job and needs a steady hand, and no rushing. You're doing a fantastic job, Stuart.

P.147 amendment to the Data Protection Law?
Yes - that's been produced and submitted because of me.
Ozouf, simply not being intelligent, wouldn't have had the idea.
It will have been Barking Bill & Co. behind it.
And - as if the were any further need for evidence of the fact he is, indeed, "Barking" - P.147 provides that evidence.
I recognised P.147 for what it was, immediately.
So toxic is it, I even spoke to Ben Queree at The Rag about it; I don't imagine for one instant a report appeared?
Some people are complaining that I'm not producing blog postings fast enough. I'm sorry, but writing the blog is very much 6th priority amongst the important work I'm doing. So I will fall behind schedule.
But - additionally, some issues arise that have to take priority over other subjects.
And I think a detailed analysis of P.147 is one such topic.
Most people won't know anything about it. That's not a criticism.
No other elected States members understood its implications - including Ozouf - until I e-mailed them all.
Just how bad is the P.147 amendment to the data protection law?
Put it this way - even if you hate me and usually disagree with everything I say - providing you are a democrat, who supports a free society, and do not agree that the state should possess extreme and oppressive powers - you will agree with me concerning P.147.

You went to court on 18th August 2009 for breaking The Data Protection Law.
Then 17th September 2009 a proposition is lodged to change the Data Protection law, to benefit Barking Bill & co....
What more evidence do you need!?
P. 147 is no big deal, the UK, also a "free society" proposed a similar amendment to Section 43 of the Data Protection Act 1998, (equivalent to our Article 43) as follows;
Surprisingly, our amendments 364 and 365, relating to schedule 18 and the power to require information, are in this group, so I shall quickly deal with them. Obviously, that relates to section 43 of the Data Protection Act 1998. Amendment 364 would leave out paragraph 6(2) of schedule 18 and insert
“In subsection (1)...he may serve the data controller, or a data processor, with a notice...requiring the data controller, or data processor, to furnish the Commissioner with specified information relating to the request or to compliance with the principles.”
Amendment 365 reads:
“‘data processor’ refers to a third party handling data on behalf of...government...or...a public authority designated for the purpose of this section”.
That would make it crystal clear that information notices can be served on anyone storing relevant data, and obviously it would cover third parties handling data on behalf of Government Departments and public authorities. I hope that the Minister agrees that those two modest amendments are sensible. Perhaps she will consider accepting them.

In essence, that's no different to P.147.
Wrong again, I'm afraid.
Your interpretation of the UK amendment is incorrect.
The UK legislation covers people or organisations that are - either directly, or in an officially designated capacity - handling and processing official data.
It does not capture an ordinary, private member of the public, nor a journalist.
P.147 does.
It goes far further than the UK provisions.
And quite deliberately so.
Bill Bailhache, Emma Martins and the rest of them will have wanted to achieve exactly that dramatic and oppressive power.

You've persuaded me. 147 is a very invidious piece of legislation, and gives great power to the Data Commissioner, and presumably her/his paymaster. It does seem very different to the UK legislation where there is an implication that offical data is being held by another body in an official capacity. 147 would encompass the man in the street.

ITN news tonight reported on the election of the President of the European Union and said that the manner by which the President is chosen - by secret ballot conducted by MEP's - is so opaque that it resembles a Papal enclave or communist Soviet dictatorship.

P147 would not have any affect on the exemptions under Article 32 - Exemption for sake of journalism, literature or art, or, Article 36 -Exemption for data processed for domestic purposes.
I don't belive that people are "dumbos".
On the contrary - it's always been my view that the average person has a good deal more intelligence and grasp of issues than 98% of those in authority ever give them credit for.
But having said that - I concede that to form an understanding of a subject, any person needs to know what the basic facts are - but in this case, the amendment of which we speak is a mystery to most.
So as I suggested in an earlier comment, I will do a dedicated posting on the subject.

It is asserted above that P147 - if enacted - would be constrained by other articles of the data protection law.
That interpretation is incorrect.
Firstly, by introducing P147 - the Jersey oligarchy would, effectively, be saying they wanted a legislative device that could be used to transcend the exemptions in the law.
P.147 also dramatically - I mean really vastly - extends the original scope and purposes of the data protection law way beyond it's original objectives - essentially to turn the law into a device to oppress anyone who didn't agree with the government.
P.147 is also - quite unarguably - simply not remotely compatible with other laws and conventions - for example the European Convention on Human Rights.
And should you still be - very naively - wedded to the notion that the exemptions in the data protection law are vaguely meaningful safeguards - just consider my case.
My handling and publication of data is - without question - fully protected - in theory - by the exemptions concerning the prevention of crime, journalism, and public interest purposes.
None of which has made one atom of difference to the Jersey authorities - who are determined to oppress me.
Even to the extraordinary and unlawful extent of the prosecution and the court deciding - once defeated by the defence case and the exemptions - to overcome that problem through the simple expedient of having the entire defence case deemed "inadmissible".
After three months of work - and about three weeks before the trial date.
And you want to hand even more Stalanistic powers to these people?

There are some very invideous ramifications to p147 for ordinary citizens. It invites fishing expeditions on almost any spurious grounds. By definition it seems if you hold any data and are not a registered data controller or data processor, you are not 'procesing data' in accordance with the law. Or put it another way anyone with a filing cabinet or a computer or even in theory a mobile phone that stores more than name and address is up for having failed to comply with the data protection law requirements.

Terry le Main - that stalwart guardian of the people's interest - is a man in a hurry.
According to the BBC News website, There will be no time for public consultation on a new scheme to protect tenants' deposits in Jersey, according to the island's housing minister.
It was agreed last month that the legislation should be brought to the states for debate by March 2010.
Senator Terry Le Main said: "This will affect 11,000 households and their landlords, and I'm doing everything I can to keep people informed."
Two systems to protect rent deposits already exist in the UK.
In the "custodial scheme" the landlord hands the deposit over to a third party who holds it until the end of the tenancy.
In the alternative "insurance scheme" a premium is paid to a scheme administrator but the landlord holds onto the deposit.
Last month Deputy Sean Power, Jersey's assistant housing minister, said about 5% of people in rented accommodation have an issue getting their money back.
Senator Le Main has published a report to update islanders and politicians on the progress of the Jersey scheme, which he says is expected to follow the custodial system.
He said: "I am keen for everyone to be aware of the issues that we need to address before this can be established.
"I would welcome any comments as we seek to meet the deadline set by the states."
The Minister has stated that any scheme would need to come at no cost to the tax payer, and should be funded from the interest on the collected deposits.
In the report he says he will work to meet the states timetable but there appeared to be no time for public consultation, or little time for a scrutiny review.
Existing schemes in Australia, New Zealand, Canada and Belgium have all been analysed ahead of the introduction of the Jersey system.
The additional option of setting up a landlord registration scheme for the island is also being considered.
Senator Le Main said: "Only in this way will I be able to support wider improvements in standards of living, and to offer deposit protection to all those in lodgings as well, something I am committed to achieving."
Yet another case of a Minister riding rough-shod over some of the more vulnerable in Jersey society!
I think we can get an idea of Jersey's official view on the ECHR from the P147 document itself in which opens with:

Anybody interested in promoting Human Rights in Jersey - which should mean everybody reading this blog - should meet in the Royal Square at 5.30pm near King George's statue.
Deputy Bob Hill will then admit everybody into the States Building where the AGM will take place.
This can be an important day for Human Rights in Jersey - but only if people give their actual support. Just thinking about it is not enough.
The amendment to the data protection law - an admission of failure?
Yes, that's about the long and the short of it.
The have no case against me.
Never did - even before they raided - and most certainly don't now - following the analysis of the 1999 evidence.
Though - as they have illustrated so very clearly - they're not going to let some piffling issue like being wrong - and having no case whatsoever against me - to stand in the way of their objective of securing a conviction.
Hence the various examples of perjury committed by Baker - and the frankly unlawful act of attempting to get the entire defence case deemed inadmissible - just as soon as they realised they had no answer to it.
They know - perfectly well - that the predetermined guilty verdict of Shaw will be thrown out - the instant the case eventually comes before a civilised court.
But they're not too bothered about that; just as long as they can keep me oppressed and obstructed from doing my political work - with two years worth of time-consuming, tedious and distracting appeals processes.
Which is why I'm here - fighting for the right for the case to be dealt with by a court of first instance that is (a) not manifestly corrupted, (b), presided over by an impartial judge - who actually possess some, vague grasp of what it is their job requires of them, and (c)is compliant with Article 6 of the ECHR.
I will not be put through two years of burdensome criminal oppression - just to enable a Knighthood to be conferred on Birt with less embarrassment - in the hope that his gross, professional derelictions will be forgotten about by the time the truth is established.

Yesterday afternoon in The House Of Commons, Mr John Hemming, MP named Jersey Nurse M.
He did not address him as Nurse M, but by his full name....
Was HE not breaking The Data Protection Law?
No - John was not breaking the data protection law.
There are several reasons why that is so.
And the first and most overwhelmingly powerful of those reason is Parliamentary Privilege.
In Jersey you will notice how the oligarchy seeks - quite improperly and unconstitutionality - to protect itself by stopping members of the Jersey parliament naming individuals they consider it to be in the public interest to name.
MPs do that kind of naming all the time.
They are allowed to do so - it is a part of their duty to do so if they belive it to be in the public interest - and their right to enjoy absolute freedom of speech in Parliament is held as inviolable.
But in Jersey people like Barking Bill and Mick Birt stop that fundamental democratic freedom from functioning.
And most States members are simply too ignorant of parliamentary history to see any problem with their ability to speak being interfered with in that way.
However - even had nurse M been named outside of parliamentary privilege - in the media for example - it still would not have been a breach of the law.
Because Jersey law does not apply in other jurisdictions, such as the United Kingdom.
But there is yet another reason why naming nurse M would be perfectly lawful.
Namely the self-same reason it was lawful for me to name him in the first place.
That being Article 29 of the Jersey data protection law, the relevant part of which I quote here:
"Article 29: Exemption: crime and taxation
(1) Personal data processed for any of the following purposes –
(a) the prevention, detection, or investigation, anywhere of crime;
(b) the apprehension, or prosecution, anywhere of persons who have committed an offence anywhere;"
So - No.
No law was broken in naming nurse M - certainly not in the House of Commons - equal, not in the UK generally - and even - not in Jersey.

I'm afraid you've simply embarrassed yourself by displaying your ignorance of how Parliament functions.
Those occasions when individual MPs can stand and speak at length - especially backbenchers - and especially about a range of their concerns - are few and far between.
The period after the Queen's Speech being one of those rare occasions.
Most MPs don't bother to remain afterwards; it is those who have something to say who make the effort.
And - in fact - unless a division is called - or something like Prime Minister's Questions is occurring - or some fundamental and contentious debate - a budget, for example - you will see that the chamber of the Commons is usually virtually empty during 90% of business - with only a few MPs present as token representatives.
Do try not to make such a fool of yourself in future.
Must try harder.

The BBC News website reports:
A group which monitors human rights in Jersey is hoping for official recognition by the States.
Politicians and non-States members make up the group which acts as a watchdog to ensure the island's Human Rights law is being enforced.
Deputy Bob Hill set up the Jersey Human Rights Group earlier this year.
He said the group is not recognised by the States as an official body but he hopes that will change now they have a formal set of rules to follow.
The group looks at issues like inheritance, data protection, the role of the Magistrate and States suspensions.
"In the view of the minister for treasury"...? what would he know about justice and compatibility.....that is like saying that In the view of Jo Bloggs the need to have human rights is irksome ,so we'll just dispense with them...may as well have sought the endorsement of Louis Walsh.
I'm asked in a couple of comments why not just name, again, nurse 'M'?
The answer is this:
There is precisely zero legal reason preventing me from naming nurse M.
Jersey laws apply no where else - except in Jersey.
I write and moderate my blog - presently - from the UK.
And - in any event - it is published on the world wide web via USA servers, so its content is protected by America's fundamental rights to free speech.
So - the questioners are quite correct - in that I could name nurse 'M' - again.
And there would be not one single solitary damn thing the Jersey legal oligarchy could do about it.
Except -
The Jersey oligarchy does not obey the law - even its own laws.
Therefore if I publish again the name of nurse 'M' - the Jersey oligarchy - people like Bailhache, Baker, Shaw - and the rest of them - would seek to oppress me in further ways because of it.
True - they would have zero legal and lawful basis for doing so - but that would not stop them.
Just as the minor inconvenience of them having no legitimate case against me - and the entire prosecution case collapsing - didn't stop them oppressing me; they simple decided to "solve" that "problem" by having the entire defence case ruled inadmissible - after three months of work on it.
Just as soon as they realised they had no answer to it - and had lost.
If we were dealing with a lawful society - with a functioning judicial system - I would not now be having to seek refuge in London from the oppressions and perversions of justice of self-regarding pseudo-Christians like Bridget Shaw.
Instead she would have behaved according to the law - read and understood the evidence - seen that at least 13 vulnerable and helpless people were murdered by nurse 'M' - would have exhibited some ethics - and would have thrown out the prosecution charges moths ago.
As opposed to placing a higher importance on her standing on the Jersey dinner party circuit.
Still - I suppose we shouldn't be surprised.
After all - Jersey Christians - like the Anglican Dean - who has a seat in the Jersey parliament - was entirely content to see the oligarchy members unlawfully stop my Christmas speech of empathy for abuse survivors.
And the Jersey branch of Christian Aid - and you really just couldn't make this up - chose to cut ties with Christian Aid UK, because the parent organisation had expressed some concern at the billions of dollars being syphoned from the world's poor by tax-havens like Jersey.
Apparently - in exchange for the theft of the feast - the world's starving were supposed to be grateful for the occasional returned fragmentary crumb.
I've never made any secret of the fact I'm not religious - but I do think about philosophical and ethical questions - and how many people respond with spiritual views to such issues.
My understanding of Christianity is, therefore, imperfect.
But I venture this view.
If all we are told of Christ is true - I would have vastly more chance of entering heaven than the average - soi disant - Jersey Christian.
To me - a real Cristian was Dr. Martin Luther King.
A man given to genuine commitment and struggle for Christian values.
As opposed to the safe, middle-class and hypocritical charade we see from well-provisioned pretenders.
