I have always denied any misconduct or mismanagement whatsoever in relation the Historic Abuse Enquiry and I still do. If I had been given a chance to put my case to a proper independent hearing then I expected to be exonerated. The case against me was based on the evidence of a number of key witnesses whose credibility is, to say the least, seriously damaged by the revelations in the Napier report. I commenced duty as Chief Officer of the Force with an unblemished record. I retired with that record intact.”

“Another thing I would have told you is that I formally complained to the Met about the Interim and further report they had allegedly carried out. I would have told you that the author of the report has now been served with Misconduct papers as a result of my complaint that submitted the first report without even interviewing me, and that he then ignored completely, evidence I gave him which showed criticism to be unfounded and that he failed to interview witnesses, including Anthropologists and Archaeologists who would have corroborated my evidence.
“As I stated earlier, forgive me taking the liberty of contacting you, but I feel that you would have been at more of an advantage if you had been given the full facts. Please read these documents. Not only do they counter the criticism made, but the Affidavit gives a flavour of the corruption and obstructions that Graham Power and myself had to work with.”

Today has seen – largely thanks to the principled and determined efforts of Deputy Bob Hill - the publication of the Napier Report into the unlawful suspension of Graham Power, the Chief Officer of the States of Jersey Police Force.
During the coming days and weeks, the Napier report – the evidence behind it – and the legal and political reality of the situation will be explored in great detail.
Indeed, of such probative evidence is the Napier Report in respect of the oppressive prosecution being mounted against me – an exercise driven by two of the key culprits exposed in the Napier Report – William Bailhache and David Warcup – the issues concerning Jersey’s overtly politically contaminated prosecution system are going to be explored in great depth in court.
But – in the mean time, for those with a little more interest - and a willingness to think for themselves – I reproduce below two brief, initial responses to the Napier Report.
One by Graham Power, Queens Police Medal, the recently retired Chief Constable of the States of Jersey Police Force.
The other by Lenny Harper, the recently retired Deputy Chief Constable of the States of Jersey Police Force.
The spin that may be placed upon the Napier Report by the Jersey oligarchy and the local media is predictable.
So, to those who wish to get below the surface – and really understand these events – I commend the two, brief responses I reproduce below.
Mr. Power pulls together the fragmented – yet key - points of the report – and displays its sub-text; the blunt reality of what is revealed – notwithstanding the terribly “polite” and diplomatic efforts of Mr. Napier.
Mr. Harper, in writing to Mr. Napier, points out several of the profound defects in the entire episode that was given to Mr. Napier to examine – and points out Mr. Napier’s own failure to interview absolutely central witnesses; not least Mr. Harper himself.
Had Mr. Napier done so – he would have realised the so-called “interim Met report” – which is still cited, as though it were a valid criticism of the original abuse investigation – is now actually so utterly discredited itself – its author is now subject to Misconduct proceedings.
When reading the Napier Report – and, in particular, the vacuous flim-flam that usually constitutes the Jersey media’s response to such issues – bear in mind one or two, ‘bottom-line’ key points:
1: In direct contradiction to two years worth of official lies – the suspension of Mr. Power was not an ‘emergency’ or ‘urgent’ action – that had to be undertaken – and undertaken at short notice. The suspension had been planned for at least two months beforehand. All that vast catalogue of “official” claims that it was an unavoidable and appropriate urgent step can now be seen for what they are – a pack of lies.
2: The prosecution system of Jersey – the Office of Attorney General – is hopelessly corrupted and dysfunctional – irredeemably contaminated as it is by political considerations.
3: The Jersey oligarchy smears, oppresses and suspends the good guys – and leaves in office and untouched, the crooks.
If what passes for a judiciary in Jersey has any corporate desire to salvage some fragments of credibility – these issues – and more – will be explored in detail - in open court – during the coming weeks and months.
Whilst we wait for those processes to occur – reflect upon the observation I reproduce below.
This war has a long way to run – and it will be won.

Initial Response to Napier Report.
“Briefing note 1.
This briefing note has been prepared by Graham Power QPM, retired Chief Officer of the States of Jersey Police. It is intended to assist editors in reporting on the “Napier Report” which I understand has just been made available to the public. The observations below are based on an initial quick read of the report. I have not been provided with a copy, or indeed any relevant information, by the Jersey Authorities. In no particular order my first observations are as follows:
1. Para 45. It is unusual for there to be a public release of advice given by the Law Officers, but editors may find the information in this paragraph particularly revealing. Its presentation is also consistent with the style of the report which sometimes does not “flag up” key pieces of information but rather leaves them for the careful reader to discover in the text. It is also sometimes necessary to read together paragraphs which appear in separate parts of the report. Paragraph 45 appears to say that the Law Officers advised that if a report from the Metropolitan Police was to be relied on for the suspension then there must be “no caveats or provisos” in the report. Paragraph 69 makes it clear that the report when received was in fact heavily qualified. Subsequent paragraphs show that the relevant parties pressed ahead regardless. The implication of these paragraphs, taken together, is that actions were taken contrary to legal advice.
2. Paragraphs 55 (particularly the second half) and paragraph 79. These appear to state that a resolve had formed “at the highest level of the administration” to pursue the suspension of the Chief Officer and that this resolve had been formed as early as September 2008, perhaps two months before the “decision” was allegedly taken. Editors may feel that this contradicts what has been for almost two years the “official version” of events, namely that the decision was taken following the receipt of a report on 11th November 2008.
3. Paragraph 80. Following the above the author refers to preparations for suspension which were taking place in October 2008. In Mr Napier’s view there was “little objective basis” for such preparations.
4. Paragraph 73. This paragraph records the denial of Andrew Lewis that he was coerced in taking his decision to suspend by the then Chief Minister, Frank Walker. However, editors may find it helpful to read this paragraph in conjunction with paragraph 22 which records the observation by Lewis that he was “coming under a lot of pressure from his fellow politicians.” Also relevant is paragraph 44 which refers to a meeting on 3rd November 2008 which was to discuss the possibility of suspension. The persons present were Bill Ogley, Ian Crich and Frank Walker. Andrew Lewis, the only person with the power to suspend, was not present. This appears to run contrary to the claims made in paragraph 73.
5. Paragraphs 66 to 68. These paragraphs cover some of the ground which was debated during the Judicial Review hearings and give support to the view that once he had been suspended from duty it was highly improbable that the Chief Officer would return to work. Or to put it plainly, what was being considered was effectively dismissal. It may be useful to read these comments in conjunction with paragraph 82 which records that once Mr Warcup had submitted his letter in support of the suspension process, his position would be untenable should I ever return. Mr Napier does not explore whether the letter was written against a background of any assurances on that issue. It would however seem unlikely that the matter was not discussed or at least considered.
6. Paragraph 97 refers to, but does not entirely resolve, the reference in the suspension documents to a meeting “earlier today” when it is now agreed by all sides that no such meeting happened.
7. Paragraph 98 raises but is not able to resolve the conflict between the different versions of the “interim report.” During the disciplinary enquiry I was provided with a document which was said to be the document provided to Mr Warcup. It is a memorandum written by a civilian employee of the Metropolitan Police which expresses heavily qualified personal views some of which are positive and some of which are critical. It makes no claim to be a corporate document written on behalf of the Metropolitan Police as an organisation. The document shown by others to Mr Napier, although containing the same words, is apparently packaged and presented as an official Metropolitan Police report. At this time I choose not to speculate further on this matter.
8. Paragraph 101. This might usefully be read in conjunction with the above. In it Mr Napier tactfully, but nevertheless plainly enough, challenges the confidentiality of the “interim report.” This is important because it was apparently on grounds of operational confidentiality that both Andrew Lewis and Bill Ogley were denied sight of the report, in apparent conflict with the advice of the Law Officers Department. Editors may also recall that over one year after the suspension the current Minister for Home Affairs also stated that he had not seen the report on similar grounds. I have a copy of the report. There are no operational issues in the report which cannot be managed by simple redaction, and in any event, operational matters were not the issue in question. The relevant part of the report deals with management issues which have no particular sensitivity. Mr Napier appears to be unable to find any serious justification for the full report being withheld from the Minister and nor can I. This difficulty may of course be capable of being explained away. However, in the absence of a credible explanation there will inevitably be speculation. It is probable that this speculation will involve discussion of whether the full report “lives up to” the claims made in the selected summary on the basis of which Andrew Lewis claims to have acted. The implication in the Napier report is that it does not.
9. Other issues in the report are self evident and I will not comment in detail at this time. Initial Response to Napier Report.
“Dear Mr Napier;
Please excuse me taking the liberty of writing to you - you do not know me, but I am Lenny Harper, the former Deputy Chief Officer of the States of Jersey Police.
I was disappointed to learn that in your just released report to the Jersey government, that you accepted and re-stated the criticisms of myself that were used as one of the reasons for the attack on Graham Power. I particularly regret that, unlike those that are also criticised in the report, that I did not receive a letter from you giving me the opportunity to rebuff, as I have on many occasions, criticisms which have been proved over and over to have no substance. Whilst I have no doubt that it was not your intention, I seem to have been given less of an opportunity to clear my name than those who seem to have supplied mis-information about Grahams suspension.
I am aware that Bob Hill asked you to interview me but you declined as you did not wish to get bogged down. Whilst I understand that, given the criticisms of me that you repeat in your report, it would have been only fair to have given me the opportunity. I would have answered those criticisms. I would have supplied you with the two documents I have attached to this e mail, one, an affidavit I made for the High Court in London, and secondly, a rationale for the operation at HDLG. I will not bore you with the details in this e mail but would ask you to read the documents even though I know you must be very busy. As an example, in relation to criticism of my Media policy, criticism you make mention of on several occasions, one of the main criticisms was that I whipped up a media frenzy over the "shackles" found at HDLG. As I explain in my Affidavit, this is untrue. Builders who had found these items five years before and left them went to the media and told the media that "the police are going to find shackles." I refused to confirm this and refused to say that I had found shackles. The main source of the criticism against me in this respect was a Jersey Evening Post Journalist by the name of Diane Simon. Yet, she originally ran a story in which she clearly stated that she had been told by outside sources that the police would find shackles. Her story clearly has me refusing to comment on the fact that we had found shackles. Yet, months later, the same journalist was writing a story blaming me for introducing shackles. Both stories were run together on one of the many blogs supported by the victims. I would have pointed all this and more out to you.
Similarly, another criticism was that I entered HDLG and dug it up on a whim. Read the Op. Rectangle Summary and decide yourself if that is so.

I hope you will appreciate that I cannot at this stage enter into any discussions about the content of my report, but I assure you I will read the material you have sent to me.
Perhaps I can just quote from para. 9 of the report where I said “Where I have ascribed views or opinions to others, I have done so only on the basis of information that was provided to me in interview or in documentation I have read.” I have not sought to go beyond the terms under which I carried out my investigations, and it certainly was no part of my brief to make any judgment on your conduct. It would, as you rightly point out, be unfair for me to do so when I had not spoken to you. I had to take account of criticisms that were made of you because these criticisms formed part of the background to Mr Power’s suspension, but that is the only concern I had with your part in the whole affair.

73. ….....Mr Lewis for his part was insistent that the decision to suspend was his, albeit one
which was supported by advice given by his advisors. He does not accept that he was bullied or coerced into making that decision by Mr Walker and/or Mr Ogley.
Who were his advisers? Why did they not give him the advice from the SG. I assume it was Ogley and co, who did not pass on the very IMPORTANT advice to Warcup, if they did, he ignored it!, or it was 'cover my arse' file note.
101. ….. It was, said Mr Ogley, a police document and it was inappropriate that he (or anyone else) should have access to it. Mr Ogley says that he was told both by the Attorney General and
Mr Warcup that he should not look at the interim report and neither he nor Mr Lewis did so. I have seen no record of any advice given, but I have not explored all sources. The Attorney General does not recollect giving such advice and believes he never saw the Interim Report documents itself. It must therefore remain uncertain exactly what legal advice (if any) was provided, and, if advice was provided at what stage in the proceedings this took place.
So did Ogley lie about getting advice from the AG? Strange that he would do so and yet ignore advice from the SG! I guess if your aim is to remove the COP at all costs you risk your job, unless you say you never saw the report, hey presto, Warcup is the fall guy, hence he will not be the next COP.

Well! like a leaf falling from a tree it flutters down and makes many swerves and turns but eventually it comes to earth and the Napier report has come to earth. Many, many words have been written over this whole sad saga but surely the time has now come to STOP the spin, lies, disinformation and outright corruption by the establishment, by this I mean the final and all out penultimate conclusion is to have a Royal Commission into this most disgraceful episode in the history of our beloved Island, for two simple reasons:
1. To finally get the truth.
2. For the survivors.
The conclusion of a Royal Commission would I have no doubt conclude that some very senior players in this saga will be spending a time at her Majesties Pleasure, there is I feel simply NO other way, and the terms of reference MUST certainly NOT be set by anyone in this Island, it must by necesity be far reaching and all encompassing of the whole affair, the government of this Island had their chance, but chose to take the path of deceipt, so be it, now the chickens will come home to roost and God help those who have been party to what everyone knows is a straight 'out and out coverup'

Disguised as a doctor of law, Portia has come to rescue Antonio, the merchant of Venice. The recollections which both the Chief Minister and the Chief Executive have of these meetings are quite different, both with regard to the content of the meetings and how they were carried out. Neither accepts that there was any improper conduct on their part. I am not in a position, having heard the competing accounts, to decide which version of events is accurate, or even which versions are more accurate than others. I mention these matters simply to draw attention to the existence of differences between Mr Power and two senior colleagues within the political and administrative spheres public sector of the States of Jersey (Chief Minister Walker and Chief Executive Ogley).
If Napier himself can't work out who's version of events was accurate, what chance has anyone got?! Doesn't say much for our dear leaders, does it?
A report with no input from W Kinnard or Lenny Harper? Not worth the paper it is printed on, except for the confirmation of various things in favour of G Power.

This why a public investigation under oath is required, where perhaps more evidence to support Graham Power will come forward from other witnesses.
I do think Graham Power should now sue the States of Jersey for constructive dismissal etc... and give the compensation to a fund supporting the child abuse victims.

Suppose someday a reporter asks Mr. Napier why he could not find evidence of a conspiracy in all this. Would he mince his words as carefully then as he has in this report? Maybe he could try to dodge his own dodginess by explaining that he and everyone he interviewed knew a conspiracy existed, but that he was simply not provided with the physical evidence and was powerless to pursue it after his terms of reference for his investigation were altered.

Re terms of reference to napier can anyone provide the comparison between the original & eventual to study?
Is there to be investigation into why Deputy Labeys original complaint was not carried through,if there is substance for investigation now why not then?
Was Napier expecting to find neatly written or typed minutes of the conversations and meetings which were held by BO, FW & co. about getting rid of Power? OF COURSE he could find 'no evidence of a conspiracy'. He asked them if they conspired - they said 'No' and so there was no conspiracy!

He did spot differences between their versions of events but, again, cannot decide who is terminally confused and who is telling porkies...
Napier is not stupid, but then neither are MOST of the people he was dealing with and they have had more than enough time to agree what must not be mentioned to him and ensure the water is muddied enough for him to be unable to PROVE conspiracy.
There are many things which cannot be proven by my good self - e.g. the centre of the earth consisting of a rather hot material - but that does not mean it is not there.

The good news is that Napier's report is now out in the open and Graham Power, Lenny Harper, Stuart Syvret and other intelligent and well versed factual commentators have an opportunity to respond in detail.
Not only respond, but in a clear and using un- ambiguous language, show the game plan of the establishment players, and how they have yet again, acted against the common values of decency, honesty and openness to try and protected their weak greedy souls.
This report has guaranteed that the battle to remove from office the corrupt, self serving, hard core who use the islands treasury to fund protection of the offices they hold, is on a downward spiral caused by their own dishonesty.
The truth like an air bubble in the deep sea will surface, helped by good and determined people, who keep asking the right questions, and getting diseased and phony answers which will not throw or dissuade them from their task.

It is a mistake to view Robert Parker as a 'member of the establishment'.
It is certainly true that he is a very successful businessman - but just because we might tend to judge Jersey business men by the frequently reprehensible examples we've seen in the States assembly over the years - it is a mistake to tar them all with the same brush.
Mr. Parker shares many of my - of our - concerns in respect of the disastrous condition of Jersey's public administration.
Secrecy, obstructions, no accountability, no effective checks and balances, near total absence of strategic planning for the community, the dangers of over-specialisation in the economy, etc, etc.
He is a very decent man who saw what was happening to Deputy Labey during the last week or so as a result of her giving testimony against corruption, and was disgusted.
As far as Deputy Labey is concerned, it is true to say we've had some fairly acrimonious differences of opinion - not, let us be grown-up - an uncommon occurrence when couples split-up. But when it comes to sticking to political principles - doing what's right - and fighting against the things that have gone so wrong for this community - we remain of the same, similar view.
We have gone our separate ways as far as our personal lives are concerned - but when it comes to fighting for the cause of decency, we remain on the same side.

There is a recurring theme running through all of this, and that is the Law Offices Department. The same people that the SCR were critical of.
If I’m not very much mistaken, these are the people who “guide” the police on which cases to investigate, or not. And thankfully on one particular occasion Lenny Harper didn’t take their advice and because of that a Child Abuser is now behind bars.
But if we look back on some of their “advice“, it does raise the old eye brows somewhat.
It was, if I’m not mistaken, the Law Offices that dropped FIFTEEN CHILD ABUSE cases in one go. Was it also the Law Officers that “advised” the police not to look into the alleged land re-zoning corruption?
In the unlawful suspension of CPO Graham Power QPM, just about everybody involved was getting “advice” from the Law Offices Department.
Isn’t it about time that an investigation was launched into the conduct of the Law Offices?
It does look like it’s September 28th 1769 all over again!

Having never met you, I can only say that a man who is unafraid to risk all to protect innocent and vulnerable children is pretty universally considered sexy. Whether it is hardwired into our female genes, or simply a socially acquired appreciation of altruism, we trust and admire those men who stand up to dangerous bullies. By way of contrast, does anyone imagine that women have any personal longings for the kind of greedy selfish men who blog hateful things about abuse survivors on the Farsical Blog or PJ? Of course not, and there is nothing sexist about our calling your moral courage what it is- fiercely attractive!

Now let us try to imagine what would have happened in a more civilized alternate universe, where Jersey's power structure decently owned up to the abuse findings as they were being uncovered by Harper/Syvret/Power. A horrible legacy of criminal child abuse and perhaps historic murder would have been examined and admitted to, with attempts made to establish victim support services and to provide both apologies and well deserved restitution. The world would have seen a genuinely contrite political establishment scramble to do the most right thing. There would have been little risk to Jersey's economy from the primary scandal, if handled in any acceptably humane way, and if lessons were sincerely learned so that future mistakes might be avoided. Tragic and horrific crimes against children have taken place all over the world without corporations relocating. Jersey however, may be permanently associated with compound evils, not only institutional cruelty to its own children but obvious ongoing corruption of every step taken towards justice throughout several decades and now. That is what Jersey is rapidly becoming known for, and that is not the kind of reputation many companies will wish to be tainted by. Talk about a place shafting itself...

Does it? Not sure I've seen any evidence to support that assertion. Which leads nicely on to this gem:

Not sure who is judging the quality of evidence at the JEP but he/she may well be certifiable.
If high level officials in office, both civil and political are conspiring to remove from employment, a person for poor performance or other proved and warranted reasons, let due process continue until the situation is resolved one way or the other.
The problem occurs when a group try and remove a person, for their own personal reasons. This conflict will require skill and secrecy for the group to succeed.
They displayed neither the skill, or secrecy protocol, even though they have a strong hold over organisations operating Jerseys’ sad excuse for an accredited media ( BBC radio - TV, CTV, and JEP )they could not keep the facts secret.
The world wide web, and the intelligent and determined opposition, caused their impressive, fully armed expensive war ship to spring a small leak that gradually went structural.
It finally sank to the bottom when Brian Napier told Jersey that Police Chief Power, had no case to answer.
What is just as disturbing is how much of the publics hard earned millions, they have spent to try and convince us that Graham Power and Lenny Harper were so out of control, even though at the time open check book Frank Walker said cost it not an issue and ACPO mentored the investigation.
Politicians and bloggers have joined this battle in a fight of good over evil. Stuart Syvret who operates this blog, Deputy Bob Hill, Constable Simon Crowcroft have been front line, and no doubt other politicos, not on the front line but there nevertheless, took up arms.
How can a politician be prosecuted for sharing data when it is in the public interest. The data itself is paid for by the taxpayer and is therefore owned by the public with a few deserving exceptions.
Brian Napier QC has stated there was no conspiracy to oust Mr Power. Yet we are told two months before there were meetings about this exact subject.
Can somebody please purchase Mr Napier a dictionary. I truly hope Magistrate Shaw owns one and has studied it.

What on earth is the JEP on about, no action was taken, Graham Power is innocent.
The JEP are in fact acting as a Judge of a case that never never took place, they must be verging on liable!

But I have too much compasion and humility for the survivors and victims of the horrendous Child Abuse that has occurred and still occurs over here to be able to bring myself to laugh at them.

Everything leads back to the top puppet master. Is this the glaring reason the Jersey Evening Post finds it difficult to report honestly and openly in order to serve its readers?
Apart from not allowing comment on some of its stories in its blog section which might embarrass sitting departmental and leading figures.
It's recent support for Mr Warcup’s outrageous and inaccurate press conferences was dismal.
Further more, the big write up of Senatorial candidate, Mr Francis Le Gresley life and work, which took place a few days before he officially stood, shows biased view point and a conspiracy to promote certain centralised and favoured candidates. Had he been a candidate this would have not been allowed, under election rules, so they worked the timing out beforehand.
For all non Jersey residents reading this, it is normal you may be thinking for a news paper to be politically biased. Of course you are correct. It is also unbalanced, cheap and demeaning in an island with only one newspaper, which does not allow for balance being taken up with a compeditor.
Being paid £334,000 pounds per annum by the Government for advertising is another big carrot.
As people become more aware that they have the power to stop buying what many regard as a propaganda machine, (the advertising revenues are on a downward spiral) but will the Government top up the shortfall to stop a useful ally from going under ? The Chairman is,

So its starting to look like the 'firm' have written off Lenny Harper, and now Graham Power without any serious fallout and now on their way to a hat-trick.
As much as I had hoped that the Napier report would have added weight to Stuart's arguments, I could not see it, especially when Mr Napier states he has seen no evidence of a conspiracy. There may have been one, but until someone speaks up it is unproven.
Witnesses need to come forward, otherwise it will all have been a waste of time!
Incidentally, I do think the 'firm' only got away with GP, because no-one was under oath or cross questioned. The story sounds semi convincing, but I could see another scenario that would fit better, but no evidence! YET
Having just listened to the recordings of the States today I find it hard to believe that the people of Jersey can accept that they paid whatever for the Napier report only to be dissed by non other than the Chief Minister....... what a disgraceful load of cobblers uttered by this man who is UNFIT to run a jumble sale let alone an Island.....
I hope that Graham Power will hold HIM accountable for yet again underming him..... take the barsteward to court..... let the real people be the judges of this man's total disrespect not only for the opinion of a QC paid for by the tax payers but also question this mans agenda for the total cover up and the failure of Justice on the Island of Jersey...... grrrr......

I can guess, he would have already been summoned for a disciplinary hearing.
However it was 'pet of the year' Warcup, so nothing, well maybe TLS will decided in another six weeks, leaving no time to complete the disciplinary meeting because Warcup is retiring, but isn't that the reason why he's retiring!

we hear that TLS can only justify the suspension of GP as, in his opinion, subsequent events have proved it correct.
Not really satisfactory, Terry. If you had no evidence AT THE TIME then the suspension THEN was not justified, regardless of the difference of opinion over what has been revealed since.

Mr Napier says he could FIND no EVIDENCE of a conspiracy, but if Bridget Shaw cares to read the full report it is so obvious to any reasonably intelligent person that Ogley and Walker along with the very conflicted David Warcup were conspiring to oust Graham Power for several weeks before the so called emergency decision by the then home affairs minister Andrew Lewis to suspend Graham Power.

Although I guess Bridget Shaw is technically correct. Mr Napier also thought it important enough to state what many would think was the obvious:-
[I have seen no evidence to support the claims (which, if substantiated, would certainly point to a need for further investigation) that these were part of some plot or conspiracy within the public service to frustrate police investigation in Jersey.]
So although he may not have seen any evidence, he no doubt listened to allegations that may have been very powerful but lacked immediate physical evidence, so if evidence is made public at some time, his recommendation is that a further investigation should be instigated.
Mr Napier also found that the evidence available at the time of the suspension, was insufficient and very weak, so much so, Mr Power should not have been suspended, but TLS would have us believe the evidence at a later date was stronger.
Perhaps there is stronger evidence yet to come, to support Graham Power's allegation of a conspiracy!

It is sad to see Bridget Shaw sucked into the web of corruption and working to the script of those above her - there was a time she was a supporter of child abuse victims as Stuart showed when he published her memo on this blog. However, she is not the first lawyer to have to be brought into line. Two UK lawyers working in the AG's office were threatened with the sack if they continued to be 'troublesome.' One of these, a female, kept the e mails which showed the pressure she was under in respect of her own and her husband's job. So far she has not produced them and the two have resisted approaches to talk, including one from the Sunday Times. Who knows, one day they may find their principles again.

Whilst I'm very grateful for the support, I'm just an ordinary man trying to do what, one might have thought, most ordinary men would try and do.
Fight against a system - a corrupt oligarchy - so openly rotten it protects rapists, the serial-killers of frail, elderly people, child abusers and those who have concealed their crimes.
Sadly - as you point out - too few people choose to stand up for what is right.
The difference between me and the Jersey establishment is not that I am any kind of hero or saint-like figure; rather - it is those 'establishment men' who are so decadent, cowardly and morally bankrupt - that I appear good in comparison to them.

But - the point you make about the church is - tragically - oh so very true.
For an organisation - a movement - that claims to itself some kind of higher authority - of exemplative moral guidance - its adherents often leave me speechless in the open display of their moral turpitude.
Do you know how many senior church characters in Jersey have offered me help and support in my efforts on behalf of abuse survivors during the last four years?
Zero.
And - it is - actually - worse than that.
I - and others, including survivors - have been pro-actively attacked, lied about and criticised by certain individuals in the church hierarchy.
As I have remarked before - I'm not religious.
But if by some chance I'm wrong - and God and Jesus exist - and that all we are told of Jesus turns out to be true - even though I'll have been an atheist all my life - I'd have more chance of being granted entry to heaven than most of Jersey's christian "leadership".

How can they put you on trial after what was quoted as a 'short break' between the two? Surely you're allowed time to prepare for your trial?

The 'media', the CM and all other Oli supporters are bellowing out from the rooftops the final sentence of a 111 paragraph report to claim "See, no conspiracy!"
However, lets actually look at what Napier said and what it actually means.

Firstly, as others have claimed, absence of evidence is not evidence of absence. The fact that he hasn't seen it (ignoring the obvious missing witnesses)does not mean that it does not exist.

I would say that this is too restrictive a view.
Did he, for instance, look to see if there were conpiracies to frustrate the prosecution of suspects AFTER the police investigation had concluded? Wateridge, Maguires, Nurse M immediately spring to mind. I am sure there are other examples of suspect actions by civil servants and/or the law officers.
I am afraid Napier simply did not address this. Perhaps it was not in his terms of reference to do so. What it does though is leave a loose end hanging, from which the Establishment can hang its laurels.

That is a fascinating question, and one which I was wondering about myself.
You see - this is a most curious state of affairs.
Magistrate Shaw did not "defer" her decision on my abuse of process application.
On the contrary - she actually read out a fairly lengthy - written, reasoned - judgment in the magistrate's court yesterday morning.
Naturally, at the conclusion of proceedings, both prosecution and I asked the Greffier for copies.
Mr. Le Heuze said to us, "yes, we'll e-mail it out to you later, it just needs a little tidying up."
Yet - here I am - four e-mails to Mr. Le Heuze - and 20 hours later - and still no copy of what was an already prepared, written judgment, that Bridget Shaw actually read out in court.
Very curious, no?
Call me suspicious if you will - but it seems to me there could be two factors at work.
Firstly - a key and absolutely central part of her finding on the abuse of process application was that the police raid, my arrest, unlawful imprisonment, and the search of the property without a search warrant - were all - illegal.
Quite unambiguously so.
She - predictably enough - was at great pains to state she didn't believe the police and Attorney General had acted in "bad faith" - but that they had, in effect, got it wrong.
There is a stipulated regulatory and enforcement regime actually written into the Data Protection Law.
It is there for the purposes of investigating and enforcing alleged breaches of the Data Protection Law.
The police ignored it all - and instead engaged in some kind of Mugabesque mass raid - by abusing an emergency search power in the Jersey equivalent of PACE.
It was also unlawful for them to imprison me for 7 and half hours - upon arrest for an alleged offence for which - even if found guilty of - does not carry a custodial sentence.
Now - having declared in open court that the central action of the whole controversy was, effectively, a criminal offence by the police and the Attorney General, Barking Bill Bailhache - the powers that be will be extremely keen to ensure that the magnitude of that finding continues to go completely over the heads of the Jersey media - and get lost, or down-played in the coverage.
Which is the first reason why they will be holding back on issuing the written copy.
The second reason is altogether more fascinating.
Notwithstanding the above finding by Shaw - she nevertheless proceeded to throw out my abuse of process application.
Her reasoning apparently being that - even though the central action by the authorities was - by her own reckoning - unlawful - nevertheless, it was still OK for the authorities to prosecute.
However - I am very reliably informed - that her judgment is legally irrational.
Given the central nature - and magnitude - of the illegality she herself found in the actions of the authorities - it was - and is - legally perverse for her to have gone on to throw out my abuse of process application.
So not only do Barking Bill Bailhache and Dave Weirdcop now face civil legal actions for the unlawful act of political oppression they engaged in - they and their system is also left with the profound headache of an internally contradictory judgment by the magistrate - which isn't going to withstand the scrutiny of the first court it comes before outside of Jersey.

On a different matter, watch out for the timing of delays until the next court "judgement" - Getting curiously close to Christmas. What price another "warning" to witnesses by sending Stuart to La Moye over Xmas. (albeit for the minimum possible time they can get away with).

What we are talking about here is not some unfortunate little lapse - that was a "a bit heavy-handed".
What we are confronted with is simply a criminal act.
What the police did - under William Bailhache's instructions - and dave Weirdcop's leadership - was unlawful.
Period.
The Police methodology - the a priori planning and activity, which demonstrates the mens rea - and the actions that followed - the massed raid - the unlawful arrest of me on site, simply to generate an artificial - and thus unlawful "power" to search, my unlawful imprisonment - and the resultant subsequent search of the property - were all illegal.
End of.
Not just "a bit heavy-handed".
Rather - the corrupt, lawless and politically oppressive actions of a police force and a prosecution system under corrupt, politicised leaders.
But don't let us worry about the ignorance and spins of the local hacks.
We've known for years now that this is the long-game we are playing.

Stuart, having a small amount of experience in this, they are allowed to change the judgment - usually minor grammatical errors without the permission of the court. I have been to the royal court to object a judgment change of an error in description.

This is the Bliar Protocol. Fabricate evidence, then invade a country and conduct a bloodbath. It was done "in good faith" therefore no culpability. I wonder if she would accept the same form of words in exculpation if you used them....?
No - quite staggeringly - I have not yet received an e-mail of the written judgment that the magistrate held up in open court yesterday - and which she then proceeded to read out to the court.
Of course - I understand that one might want to go over it, to check for typos etc.
But it is taking an aaaawfully lonnnng time.

But - in Jersey justice - it is not unknown for even court tapes to be meddled with. Not something in my personal experience - but I know it has happened to others in years gone by.
Now - you understand I do not condone committing contempt of court by engaging in any form of electronic sound or visual recording in court?
It is a very serious offence - and people get locked up for such conduct. Even 12 month sentences are not unheard of.
But - you know - some of today's mobile phones have 32 gigs of memory, and are therefore capable of recording an awful lot of audio. Even in stereo!
Alas - I don't possess such a phone - only a nearly broken 5 year old Nokia. But - it serves me well - and, anyway, I'm told by those who own them that these new, fangled modern phones can be very complicated to operate correctly.
Why, a friend of mine was telling me only the other week how he had inadvertently - quite accidentally - recorded about 3 hours of a dinner party on his friend's stag night. Naturally he deleted it all - as some of it was somewhat embarrassing.
But - just goes to show. Accidents do happen with modern technology.

1) when you updated your driving licence, you did not have to undergo a test?
2) you never had your licence taken away through suspension or otherwise?
3) in renewing your licence, there was no requirement to undergo any medical tests?
4) although the JEP say your were found guilty of driving without a licence, if the above is correct, then surely the real issue was not a serious one, but was merely an administration oversight, not quite in the same league as the headline would suggest?
5) how many people in Jersey have been found guilty of this type of administration oversight in the past ten years?
6) I assume that technically you had to plead not guilty, because not doing so would have jeopardised your abuse of process case mainly related to the illegal raid of your home in 'fishing' for whatever and claiming it was a Data Protection issue?
7) As far as I am aware, if evidence is obtained illegally it cannot be used against you, a bit like privileged information, so how come you are still having to face the charges?
8) Did you release the Police Report on Nurse 'X' in bad faith!
9) Did Graham Power and Lenny Harper conduct the HDLG investigation in 'bad faith'!
10) Did you get hounded out of the States, because you made a true statement in 'bad faith'!

I am surprised that the mainland media have not picked up on your court case, as well as the way Graham Power has been treated.
I remember the incident involving the Tory MP Damian Green which was all over the news a while back, and yet it pales in comparison to what they are doing to you.
I also notice the local media have continually avoided giving details of your alleged data protection offence. Is there a legal reason forbidding them from doing this or are they simply trying to paint you as a lawbreaker before the trial commences?

This week I watched the ITV presentation of Cameron’s first party conference speech. At the end of the segment I switched over to the BBC news, coincidently they were airing the same piece.It may well have been an entirely different oratory. Deviously hacked and edited, the result made Cameron appear harsh, immovable and uncaring. Had i not seen the previous offering, it would have instilled in me quite strong reservations concerning the Cameron camp. The power wielded by the BBC and other media outlets simply must be curbed." this from this weeks Euroweekly, the most widely read English newspaper here in Spain.

I've known Bridget for around 20 years through her animal welfare work, and I know for a fact she has no interest in computers or the internet.
If someone is posting as her on the JEP online (and it's not just a selection from the letters page of the Rag being referred to, to which she is a sometimes contributor), then it's definitely someone impersonating her, rather than Bridget herself.
Bridget and I are complete opposites when it comes to supporting Stuart - having had an extremely heated 'debate' on the matter the last time she brought up the subject in my presence, where I left her in no doubt as to where my allegiance lay (the look on her face was an absolute picture!)- but I just felt I had to set the record straight on this matter.

One of the ironies of "that" Bridget - Bridget Murphy - is that I took an animal welfare - ant-fur import - petition to the Jersey parliament on behalf of a group of constituents - including her.
I've no regrets about doing that; it was the right thing to do.
But just what Bridget M's "values" are - God only knows.
As much as I abhor cruelty to animals - I despise cruelty to children even more.
For all her hollow animal rights posturing - she appears to attach far greater importance to such imperatives as the likes of Bill Bailhache and Mick Birt getting their knighthoods - than she does to the suffering of abused children.
In my experience - children love animals.
Both share an innocence.
Bridget M imagines herself to be some kind of christian.
Let us remember what Jesus is said to have said in defence of children.
And let us wonder just what judgment awaits the likes of the Bridget Murphy's of this world.

I have had well publicised differences of opinions with Ms Murphy in the past and where we differ is the nature of 'Human Rights' and 'Animal Rights'.
I was instructed to remove a problem seagull nest that was causing the parents to physically attack a disabled person who had been 'selected' as a threat (I won't go into the ethology here but this does happen). The distress caused by being attacked by a pair of 'un-fazed' gulls every time you left the house was at an extreme level. With appropriate legal cover I removed the offending nest and newly hatched offspring which was the reason for the 'viciousness ' and focus.These were despatched humanely and within 15 seconds of getting to the nest (which was three storeys up and in a dangerous position).
I regarded this as entirely necessary to prevent extreme human suffering and was unavoidable (once people had made gulls welcome by providing unlimited food in the urban environment and that is the principal causation!).
Ms Murphy public decried this action on the basis that the nesting gulls had more rights than the disabled person and shouted this on every available media.
I emphatically disagree!

In GB and the US there is an established history of Humane Associations quietly combining child and animal protection and welfare efforts.
Why? Humane organizations have found that it is often easier to attract public support and donations for causes which place the greater emphasis on the protection of innocent animals.
It is shocking to see the sizable sums donated to these causes, oftentimes by wealthy widows leaving entire million + $ estates in honor of a pet cat or dog, or in a trust to ensure it's life time care.
Some top child welfare and advocacy nonprofits have "piggy-backed" on to organizations which appear to be primarily only for animal protection, for that reason, easier fundraising.
Sad, I know. Maybe if the world's children were treated as the precious individuals they all are, animals would be better cared for by the more compassionate societies which would result. But for now, there are a vast number of Bridgits out there.

On the subject of people concerned with Animal Welfare in my experience I find some of the least child friendly people I meet seem to have pet animals - sometimes several. In fact some famous dictators, psychopaths and serial killers were known to be devoted to their furry friends.
It doesn't make you a good person!

It's true that some deeply dangerous characters have liked animals - but let's not fall into the trap of imagining that anyone who cares for animals must, axiomatically, not care for children or people in general. It ain't necessarily so.
I really like animals, and believe they should be treated with care and compassion.
I also believe - even more so - that children should be treated with care and compassion.
What I find quite bizarre is the apparent dis-balance some people exhibit when portioning out their affections. As Chelloise pointed out - leaving millions to an animal welfare charity - and not one penny to a charity for children.
I just don't see a care and respect for animals as being mutually exclusive to a care and respect for children.
On the contrary - in my experience - if a person is a fundamentally empathetic, decent human being - they don't need a particular, narrow cause upon which to exhibit their intrinsic empathy and care.
But that broader view can also be seen at work when considering people who are maniacs.
Jeffrey Dahmer was well down the path of torturing and mutilating small animals before he began abusing boys and murdering and cannibalising men.

Completely agree Stuart. Also some of the best people I know respect and care for all creatures - children and animals! I tend to take this to the extreme and literally won't hurt a fly (or a wasp or a slug or any living creature)
Care for our environment is the key to having an environment worth living in!

Why do we bother with courts in Jersey?
No cases get to court unless the AG, alone (or in cahoots with shady co-conspirators if you like), decides that there is enough evidence to convict.
Therefore, each case that goes to court MUST be guilty - QED

Jersey’s States for reasons probably of corruption, have elected to put billions of pounds worth of publicly owned property and land at arms length from the States of Jersey Government into a quango.
This new quango is called the Jersey Development Company. It is to be staffed by the very same people that gave us the appalling waterfront who are granting one hundred and fifty year leases to out side interests, behind closed doors.
Politicians, let alone the public can ask some simple questions and get no answers. Some example’s may be, who owns the new buildings including the bus station, and what rent are the new owners getting? Why is the aqua pool costing the taxpayer around £1,300 a day? Why is the CEO Mr Izatt getting bonuses not linked to profits? Why is the same person paid £287,000 a year while being in a safe and secure position, as apposed to a job battling open market competitive forces.
Before the public could approach a deputy or other member of the States regarding an land issue, as all public property and land comes under a quango, it is made ever more difficult to find out about property deals, which may affect the community.
What I personally find so galling is that the islanders land and property, was seized in this way without a referendum. Will the same occur, as the gangsters and half - wits as you have labelled them Mr Syvret, move towards trying to gain independence for the island?
Or will the islanders stand up and say enough is enough, in what is fast being labled as an incompetent and indeed, as mentioned in the opening statement, a corrupt, poorly run Government?

I mean - really - what is there left to say?
Even if I felt the vaguest inclination to seek to re-enter politics - which I don't - it is decisions of that nature which strongly remind me of the utter futility of being involved in Jersey politics unless you are a gangsters and/or halfwit.
What can those States member who voted for this catastrophe have been thinking?
Seriously - have they all contrived somehow to never actually look at the intergenerational disaster that is the Waterfront?
Have none of them thought about just what an economic and financial apocalypse it has been for Jersey people?
The Waterfront is pretty much universally regarded as an unparalleled disaster by 90% of the population of Jersey. And they're right.
But our "Glorious Leaders" obviously don't think so - so want to inflict the same methodology upon the rest of Jersey.
But - you know what?
I don't blame those States members.
They are - after all - and quite obviously - on the available evidence - largely a collection of gangsters and halfwits - so what other outcome would we expect?
No - the real blame lays with the broad population of Jersey.
The turgid accretion of buffoons and grifters who sit in your parliament did not force their way there - with guns in hand at head of a militia.
They are there - because you - yes you - you utter damn fools - voted for the clowns.
As you sow - so you shall reap.
People get the government they deserve.
And there have been alternatives - but you haven't voted for them often enough - strongly enough - have often continued to cast votes for the traditional cretins - and have been too apathetic - and have not mobilised and encouraged others to vote for decent candidates.
The population of Jersey must - at the last - waken from their torpor - look about them at the administrative, economic and environmental catastrophe to be seen all round - and take responsibility for it.
It is of their making.
Just like most of the voters in St. Clement persist in voting for Jersey oligarchy candidates - yet forever complain about the gross excrescence of the new waste incinerator.
You can't complain - you have voted for most of the politicians who supported the construction.
In the Deputy, Connetable and Senatorial elections - you could have voted for better candidates.
You didn't.
The vast incinerator that consumes your skyline is a punishment.
A punishment inflicted upon you - for having broadly voted - year after year and year - for the kind of States members who - not content with having annihilated Jersey's Waterfront - now happily intend to do the same thing to the rest of Jersey.
You - Jersey voters - and non-voters - are to blame.
You could have voted for better candidates; you chose not to.
You can take a horse to water but you can't make it drink.
All that Jersey could have - and should have - been - has been destroyed.
And the buck stops with the people of Jersey.
The morons who have led us to this end would not have been in power - if you had not enabled them - one way or another - in being there.

Yes – and it appears to be accurate.
In a nutshell the judgment is Catch-22.
Bridget Shaw repeatedly asserts throughout the document that I "haven't shown this" - and I "haven't proven that" - and she has "not found the other" - etc - etc - etc.
It's pretty funny actually - because when one is familiar with the case as I am - and you read back through all the many transcripts - it is evidenced - and there to be seen - time and time and time again - how I have repeatedly sought disclosure of the evidence that would - emphatically - have shown my arguments to be correct - to be evidenced.
But Stephen Baker has always argued that in "his view" that evidence "was not relevant" - therefore the "prosecution would not disclose it".
And Bridget Shaw has a 100% record of resolutely agreeing with Baker – in deciding that the evidence in question should, indeed, not be disclosed to me.
Therefore she repeatedly asserts throughout her judgment that I haven't produced sufficient evidence to prove my contentions - which - even if true - would be because she and Baker have contrived to deny me access to the evidence in question.
And note this well - there has been no claim by the prosecution that the evidence I have sought disclosure of - such as, for example, relevant e-mail correspondence between Bill Bailhache, Warcup, Emma Martins, Minty, Ogley etc, etc - does not exist. Nor that the evidence concerning the covert surveillance involving Gradwell, Mark Cane and Julia Jackson does not exist.
The prosecution and Shaw have accepted that it exists.
They have just decided that they don't want to regard it as "relevant" - therefore they have ensured it was not disclosed to me.
So Shaw says I haven't proven things to her satisfaction - but that's hardly surprising - because she has decided I can't have access to the evidence that would prove things - because I can't prove that that evidence is "relevant" - but I can only prove it's relevant if I have access to it - but she and Baker assert it isn't relevant - so I can't have access to it - so I can't adduce it in court - so Shaw argues I haven't produced evidence to prove things - but she won't let me have the evidence - because she says it's not relevant - and she says it's not relevant because Baker has told her so - but I can't adduce the evidence that might disprove that - because I'm not allowed to see it - so I can't argue for its relevance, and it being admitted to the trial - because Baker doesn’t want it to be - so I can't use it to persuade Shaw of my argument - because she has ensured it isn't disclosed to me - but I can't challenge the non-relevance claim - because they won't even let me see the evidence - and Shaw is able to throw out my abuse of process application - because she has ensured that she is not confronted with the difficulty of evidence that would go against the decision she wanted to arrive at - because she has dodged around that problem by just declaring all such evince - that would prove my claim - is "not relevant" - therefore she's able to write in her judgment I haven't been able to prove XYZ - but I have been denied access to the evidence - so I couldn't adduce that evidence - because she and Baker have decide they wanted it to be deemed "non-relevant" - but I can't argue against that decision - because they won't give me access to the evidence to enable me to challenge their view on relevance - so I have to argue in court on the basis of 95% of the relevant evidence having been refused disclosure to me - and Shaw then concludes I haven't produced enough evidence - but I can't produce the evidence - because she has ensured it is not disclosed to me - so then - err ...
I think you get the picture.
Like I said – it’s actually funny in a perverse kind of way.

"Police officers denied training for seven years." I am just a little mystified at this bit of nonsense. Graham Power was red hot on developmental opportunities for officers and was an active member of the ACPO/Bramshill system which was dedicated to the development of officers for promotion to higher ranks. In a force where there are only three officers above the rank of Chief Inspector the current fad for promoting officers young is certain to lead to stagnation. We tried to alleviate this by a whole raft of measures. The most obvious was sending officers out to UK forces at Management level to broaden their experience and their outlook and to expose them to policing different environments. Many officers were sent on various types of Management and leadership courses all over the UK and further afield, for instance the FBI. At any one time there were always a number of officers on such courses. The officers at Chief Inspector rank were regularly rotated to ensure that each was not disadvantaged by not having experience in all areas of operational and command responsibilities. A very firm and well managed appraisal system backed up by career development interviews was used to identify weaknesses and for development. All this of course is not just on my say so. HMI came in several times and commented favourably on the manner in which officers were being developed. I suspect Graham Power will be particularly irritated at this claim as career development was a particular interest of his. I can only assume this has come from the same vested interests who said there were no cellars or at least one of the camp followers. Lenny Harper

As I say I have not read the article BUT the headings to the pictures say it all, in a nut shell 'Good guys and bad guys/girls'Diane why don't you print (in full) every word of the affidavits of Graham Power, Stuart Syvret & Lenny Harper and then as an investigative journalist ASK where is the similar affidavits of TLS, ILM, Bill Ogley, Frank Walker, Bill Bailhache, Philip Bailhache, David Warcup, Andrew Lewis. We are not idiots and I for one know that 'perjury' is a very serious crime, so come on Diane ask the the above to swear on oath that what they are telling use is the truth, but sad as it is the truth is something you would not know if you tripped over it. History will be the final judge of this and the book of names will be written, what one must ask it which side of the ledger will your name appear?

Nothing at all mystifying re: police training, just look at who wrote the article.
Now what is the story, behind the story or the Diane Simon article? why now, for whos benefit, to support what, divert attention from what or whom oh so many questions.
The article by Simon was so poorly written it was hard to decipher the meaning. If it is another of her attempts to rubbish the former police administration it is too vague to accomplish much there, and instead resembles a half-hearted essay by someone who had to guess at the assigned topic.
Michael O'Connell would have been 58years old this month (I don't recall the actual day.)
44 years of his life so far that he did not experience because of the tragic childhoood he had and also because the care system in Jersey failed him. As you know he took his life at the age of just 14 as he dreaded returning to Haut De la Garenne following a fairly minor offence. I have no doubt that is where the Jersey "legal" system would have placed him once again.
Stuart was moved by this story of a boy he never met and it was Michael who inspired the Father of the House speech that was greeted with such venom. It is Michael's story that is at the heart of the Haut De La Garenne abuse enquiry.
I did know Michael from the age of 10 to 12 and I have made sure that Stuart, Rico, VFC and others now know what a very special person he was. He was intelligent, sensitive with a wicked sense of humour.He cared about other children and he often got angry with good reason when he felt something was unfair. I will never forget him - his face is etched on my memory.
Michael rest in peace - without knowing it you have helped so many people to have their voices heard and that place can't hurt any more children now. Justice will come!

heated conversation at bowls club today,my father who reads my blog printouts was hearing the ep readers (believers) of yesterday paper commenting on the police story line, they (the believers) will not hear of reading the printoff to consider another side of the story (Lenny Harpers)as any "journalist" would you think do.
They are brainwashed, excuse the compliment of brains!

Too many of these children were written off as a waste of space. People can laugh if they like, but I believe that one day all the people will stand in front of God and see each other, just souls naked before God. I so strongly believe that there is a better place, where justice is the rule, not the exception. I am sure that poor boy and many other children who died because the hands they were placed in were hard and cruel, I am sure that they are in a better place already, where no unkind soul can enter.
