I reproduce below a press-release issued by two opposition members of the Jersey parliament.
They, like me – and many other people – have been corruptly oppressed by the
stark and evidenced criminal racketeering enterprise that the Crown syndicate
has long-been in Jersey.
Alas, not one of the corruptions inflicted upon these two politicians
and, in extension their constituents, comes as any surprise to me. I’ve been pointing out the manifest ultra
vires and corrupted state of the administration of “justice” in Jersey for
years. For a long time people liked to say that that was just me – “being
difficult”.
But facts-are-facts. The Crown’s “eyes & ears” in Jersey – the “Lieutenant
Governors” – and their staff – are permitted to take lucratively financial benefits
and settlements from the Jersey oligarchy.
I guess the question for readers in the United Kingdom and the international
community must be “just what does the British Establishment have going on in the
tiny, secretive, corrupt, oppressive tax-haven of Jersey – where children get
abused, and their attackers are protected - that it will so casually protect and
support such overt corruption of the very mechanisms of justice – yet whilst happily
engaging in wars in other jurisdictions in supposed opposition to such corrupt
denials of democracy and the proper rule of law?”

Two Members
of Jersey’s Parliament have today called for the UK government – which has overall
responsibility to ensure “good governance” in the Channel Islands - to urgently
investigate what they describe as the “spiralling evidence of the wide-spread
breakdown of law within the island’s justice system.”

The Deputies
say that “justice in the island” (which came under the global spotlight with the
unfolding of the ‘institutional’ child abuse scandal in 2008) “is being
betrayed by a mixture of top level incompetence, corruption and intimidation.
Much of this being a direct reaction from those in the island’s Establishment
desperate to bury any dissenting opposition to getting to the truth about decades
of child abuse cover-ups.”
“Far from
ensuring justice for the people of Jersey our Law Office has become the tool of
choice for the clique at the apex of power to try to silence and, if necessary,
drive from office or ruin those who dare challenge the established order; or
persist in fighting the cause of the ever-growing number of people coming
forward to complain of corruption; whether relating to child abuse or abuse of
the legal process.”
This has
already seen the former Chief of Police (the initiating officer of the child
abuse investigations), Mr. Graham Power QPM forced from office by an illegal
suspension that failed to result in any disciplinary charges. It has also seen
a former Health Minister, at the centre of revelations about the abuse, ousted;
and currently being [REDACTED DUE TO DISCRIMINATORY
JERSEY GOVERNMENT REPORTING RESTRICTIONS DIRECTED AGAINST STUART SYVRET] by
a blatant misuse of the Data Protection Law within [REDACTED DUE TO DISCRIMINATORY JERSEY GOVERNMENT REPORTING RESTRICTIONS
DIRECTED AGAINST STUART SYVRET] Royal Court [REDACTED

STUART SYVRET] – all being paid for out of the tax coffers. Files and
records relating to children abused within the Jersey care system have
conveniently ‘gone missing’ from within both the Police system and government
departments. Evidenced cases against abusers have inexplicably not been pursued
by the island’s Law Office.
Banning
of US Journalist
This
manipulation of justice has even seen the contrived banning of a respected US journalist,
Leah McGrath Goodman, from the island once it became apparent she was
researching child abuse cover-ups and the island links to Jimmy Savile. A ban
only lifted following the intervention of UK MP John Hemming and an
international petition campaign initiated by Deputy Trevor Pitman himself.
Trevor Pitman states that along with two other political ‘backbench’ colleagues
the number of complaints alleging corruption received from members of the
public has reached deeply disturbing proportions in recent months.
Legal
System - Corruption
These
complaints have included alleged tampering with court transcripts; destruction
of and refusal to look at evidence; inconsistency in sentencing; and even
perjury and collusion between lawyers. The recently leaked "BARTON REPORT" of a disciplinary hearing
involving police at the centre of the illegal bugging allegations in the ‘Drug
Baron’ Curtis Warren case even revealed claims of falsified and unsigned
statements being presented instead of original documents.
Yet the
Deputies say the cold, hard evidence of the justice system being in desperate
need of external investigation; and the depth of the obstacles facing victims
of the cover-ups was only brought home to them after they pursued the island’s
only, and hugely influential, pro-establishment newspaper, the Jersey Evening
Post to court for defamation along with one of its millionaire clients. The newspaper
and its estate agent client Broadlands had mocked the couple after Trevor
Pitman’s election, falsely claiming they had increased their salary four-fold
by entering politics when in reality they had taken a drop in income of
thousands.
Jurat
Supports Paedophile in Previous Job as Vice-Principle
“It was
shocking enough given the evidence that we then found ourselves losing the
case,” say the Deputies; “we subsequently then discovered that the Senior Jurat
(lay judge) John Le Breton had been allowed by the Bailiff’s Office to sit in
judgement of the case even though he was a personal friend of the newspaper’s
longest-serving Director; the two regularly socialising together and even going
to dinner at each other’s home. All of this being evidenced”.
An even
bigger shock for the Deputies was the subsequent leaking of a government
suppressed report (the 1999 Sharp Report) into another horrific child abuse
scandal at the island’s Victoria College (an exclusive ‘fee-paying’ secondary
school). The report revealed that John Le Breton, as Vice Principle had refused
to look at evidence against a friend and colleague, the predatory paedophile,
Andrew Jervis-Dykes.
He instead
wrote in support of him claiming amongst other things that: Jervis-Dykes had
served the College in an ‘outstandingly competent and conscientious way’; that
unless police decided to prosecute, the abuse would be seen as ‘an
unsubstantiated allegation’. Le Breton even appealed for the paedophile to be
allowed to stay on at the school and if he had to resign be allowed to do so
with ‘some dignity’. Incredibly Le Breton was put forward for the Jurat role by
a politician who was both on the College’s Board of Governors at the time and a
former president of the government’s Education Committee!’
The Deputies
add, “when you bring this to the attention of the Chief Minister, Bailiff (Head
of Judiciary and Legislature) and Deputy Bailiff, where both Crown
Officers just happen to also be friends of the Jurat in question - you are
told: ‘if you don’t like it – appeal’. The Crown Officers know full well, that
the above information not only came to light after our case and has
implications far beyond this alone; but that it would necessitate at least
another £30,000: monies that most ordinary people do not have.”
Jurat Le
Breton was allowed to sit by two successive Bailiff’s for a period of 14 years
– including sitting on some child abuse cases until retiring just after the
Pitman’s’ case. “This demonstrates just how unfit for purpose Jersey’s system
of election and monitoring of Jurats is”, says Deputy Shona Pitman, adding “how
in the 21st Century can Jurats be elected in secret by only
politicians and lawyers – many of whom will regularly be friends of those
proposed?”
UK
Justice Minister fails obligations of good governance
Yet even
with the backing of around a dozen equally appalled fellow politicians and
prominent justice campaigners, the Deputies say that the injustice they have
been dealt is as yet failing to be adequately dealt with as it should by the UK
justice Ministry. “The evidence in our case is overwhelming,” say the Deputies,
“just as it is in many other cases. Yet even when presented with all of the
details (as outlined above) and letters of support from other concerned public
figures, the excuse from Lord McNally has been that as ‘Jersey has its own
justice system we can’t really interfere’” (see enclosed correspondence).
“Most absurd
of all perhaps’, add the Deputies, “is that ‘the Justice Minister instead
offers to ‘forward our concerns’ to the Bailiff – the very individual who has
allowed all of this to happen! What this shows is the deeply troubling attitude
to justice from those holding power within the justice system here and the UK
Minister responsible for ‘good governance’ in a small and apparently
‘insignificant’ jurisdiction’.
“At the
bottom line”, conclude the Deputies, “if these failings are allowed to
continue, if successive Bailiffs and other Crown Officers can allow an
individual who refused to look at evidence against a predatory paedophile yet
supported him – to sit as a Jurat for 14 years; including on subsequent cases
of abuse what hope, we ask, have the victims of Jimmy Savile and the Haut de la
Garenne child abuse scandal of getting justice here? What hope has any ordinary
citizen who rocks the Establishment boat? The answer must be a resounding none.
It is time the UK government stepped up to the plate and fulfilled its
obligations. Should they not do so then it can only be concluded that
Westminster must be complicit in all of this.”

Also can anyone recommend a good history of the island - especially it's political history? There seems to be a dearth of information on the subject.
With reference to Jersey and the Nazis I suggest you read the excellent book Never To Be Forgotten by Joe Miere.
What is very interesting is the sections on Nazi collaborators and informers.The names and addresses of some of these informers are held at Jersey Archives file no.DZ/D/H9/2 unfortunately you can't see them as they are 'closed'files and cannot be opened till 2040.No doubt all those guilty in helping send people to concentration camps would have passed away by then and could not face justice.You know,a bit like famous paedophiles who are only outed after they have died and therefor cannot grass anyone else up.Great isn't it having known Nazi collaborators walking around this island safe in the knowledge their crimes are still being hidden by the States.

The Germans are not that stupid, and as Hitler was a genius on several levels able to manipulate, give exciting speeches, plan ahead with his own vision, have all the skills needed to put himself in power in a failed German economy do you think the Germans with reasonable intelligence had not noticed.
Of course they had, but it was to late, he had become to powerful, and was already using brutality and violence on out spoken critics.

ILM got 34 votes, you got 18. That's to say that 33% of states members at the time were prepared to make a protest vote against ILM. Hardly a ringing endorsement of his credibility at the outset, was it?

The Crown is determined - one way or another - to politically imprison me again. Not only to sabotage any effective in-put I might have given to a Committee of Inquiry - but also to sabotage - to pervert justice via witness-intimidation - the legal cases coming on-stream in London.
The Crown knows its position is indefensible - on any true and just application of the law and the good administration of justice - and on any consideration of the evidenced facts.
So it's a case of obstruction, harassment, psychological war, threats, molestation, fake, corrupt repressive "legal" actions, arrest, imprisonment - etc, etc.
But - of course as will be obvious to any thinking person who's followed the scandals - the two arenas - the Committee of Inquiry - and the London legal actions - are - in a manner of speaking - dealing with the same core issues.

The London legal cases will - genuinely - tackle THE core issue - which is that the Crown Prosecution Function in Jersey is a wholly corrupted and structurally ultra vires entity - in no way compatible with basic rights, the proper rule of law or the protection of the weak from the strong.
And certainly - at present - I see precisely zero that makes me inclined - at all - to co-operate with any Jersey CoI - let alone this one.
I mean - come along! The decisions and processes in developing, designing and staffing this CoI have had directly and centrally conflicted individuals - at the very core of that process - like Philip Bailhache - who Ian Gorst in his manifest weakness and inadequacy permitted to take part in the Cabinet discussions and decisions instead of pointing out his obvious confliction and ordering him to leave.
It cannot - surely - be expected by any reasonable person that I - a key witness - would take part in a process actually designed by one of the very key, corrupt, malfeasent individuals whose conduct should be inquired into?

I was out at a dinner in Jersey last week attended by many of the "Great and the Good" and the subject of Sir Phil Bailache came up. I was genuinely surprised at how many "senior" people were openly critical of him over the recent Plemont/National Trust issue. It appears that not all those who you might think of as solid Establishment type are firmly behind him.
Of course you might consider this as "rats leaving sinking ship" mentality but I honestly felt that many people felt he may have overplayed his hand. If that is the case, then I genuinely hope that gives you some comfort.
I'm not surprised that Jersey's "Great and the Good" should be so ignorant, ethically bankrupt and devoid of any grasp of reality that many of them should only have woken up to the plain derangement of Phil Bailhache over a mater concerning the expenditure of tax-money.
If there had been any meaningful capacity for intellectual analysis or moral involvement on the part of Jersey's oligarchy - they would have been objecting to the criminality and corruption of the Bailhache Brothers a long time ago.
For example - over their repeated illegal and corrupt concealment of child-abuse - and many other gross crimes by Jersey's polity.

Oh that depends whether another of Micky Birt's friends and appointees has me imprisoned again first - for trying to expose Birt & Bailhache's crimes.
Obviously, that occurrence - like the previous diversionary witness-intimidating oppressions and false-imprisonment - stops any clocks running in respect prescription periods.
So, when the London courts?
All in good time.
For example - this time - before any live hearing - on any of the issues, even initial preliminary applications, occurs - I'm going to submit a formal legal notice to the Lord Chief Justice re potentially conflicted judges - and the requirement for a tribunal that meets the test of the appearance of objectivity.
I mean, this time I'm not going to accept turning up to the Royal Courts of Justice - to discover the two judges are (a) a man with a history of being accused of sexual crimes - and (b), a friend of Phil Bailhache's - like last time.
A pre-emptive objection to any such confliction in the tribunal will be established - and any such conflict and refusal to recuse will - as a cause-in-itself - be appealed to Strasbourg.
After, of course, having first gone by Johnny Sumption's friends in the Supreme Court.
Hey - I want an objective, transparent and impartial tribunal.
As is anyone's right.

Very well, so you've made it clear what your strategy is and what your target is. You're going to file in the High Court a legal claim, containing every Jersey scandal and corruption you know of, as evidence of an unlawful failure by the Crown, Privy Council and Secratary of State to secure and enforce the basic rule of law in Jersey and an unconflicted judicial system. That gets your evidence on the historic record. And then you argue, probably meticulously and correctly at every single stage, for the pure objectivity of the courts and justice, and if you don't get that, make it THE issue in itself; as an especially relevant, justified and reasonable stance given that the case arises, at base, out of what is, plainly a cause of action of judicial and Crown corruption.
I've followed the cases and the evidenced history enough to be sufficiently familiar with it to say that you appear to be correct in evidence and in law.
But, surely, given the stakes, which you understand full well, you know, just know, the system cannot let you win?
But perhaps that is the point?
Perhaps what you seek is not some just legal victory at some incidental staging-post and a few million pounds and a few days' headlines? Perhaps what you seek, in your defeat, is a place in history as a man who exposed and humiliated the very Crown and the voodoo nature of its ghost powers as, essentially, lawless?
Well, if the Crown - and its powers - are not lawless - then like every other public authority - the Crown and its embodiments and executive decisions - will be accountable.
Will be open to scrutiny - and the rule of law - and the administration of justice - in the courts.

New Magistrate Appointed
A new Magistrate has been appointed for Jersey.
Current Assistant Bridget Shaw has been chosen by a panel led by the Bailiff.
The position was due to be filled by Ian Christmas - who resigned in January, four months after being jailed for his part in a property fraud.
Mrs Shaw has presided over court cases since 2008 and will be sworn in to office at the Royal Court next Friday.
She graduated in Law from the University of Durham in 1983 and joined the Law Officers' Department as a legal advisor in 1998, becoming an Assistant Magistrate in 2008.

No, not at all. On the contrary - The Jersey Evening Post ran vast articles condemning me as some kind of despicable, wretched maniac and anarchist bastard for having attempted to give such a speech.
The JEP even printed one of their fulminating, spittle-flecked, barking-mad tirades of hate & fear in an editorial leader comment - pronouncing to the world that I was, essentially, some kind of lunatic for speaking out on behalf of the abuse survivors.
Mind you, that editorial leader comment was a John Averty special - so we couldn't be surprised.
Something good, though, came of it.
Because the directly conflicted child-abuse concealing criminal Sir Philip Bailhache had stopped the speech, the public didn't know what "the fuss was about" - so the JEP, commonly known as The Rag in Jersey - had to print the full speech.
A number of abuse survivors - and relatives and friends of survivors - read it, and made contact with me over the next few days.
Included in this number was a brother of a boy who had hung himself - in 1966 - rather than be returned to what he had faced at HDLG, from where he had fled.
That time - when my speech was barracked, shouted-down - and then the Crown's agent Sir Philip Bailhache unlawfully joined in with the thuggery and cut my microphone then adjourned the meeting - was the darkest moment for me. And those next few days.
I had to spend days and evenings counselling abuse-survivors who were utterly shocked and traumatised all over again at the conduct of their parliament - towards the first ever member who had spoken up for them.
Several of them felt suicidal at the disgusting spectacle. I felt little better myself.
The Jersey Evening Post - John Averty - were rabidly, despicably in support of the Jersey oligarhcy and the suppression of my speech on behalf of those damaged survivors.

I don't know why anyone is surprised about the behaviour of Bob Key the Dean of Jersey. You were expressing doubts about him back in 2008 Stuart, and having met a few past Deans of Jersey during my life I found them creepy and insincere to a man. Like the role of Lieutenant Governor it is a good gig for someone outside the island to have an excellent living and plenty of prestige. Unfortunately it does not require them to learn about the people of Jersey and their needs or integrate with the man or woman on the street. Both roles are expensive, anachronistic and should be scrapped ASAP

(they probably didn't understand it)
I never did get them to publish the bit about my pre-election comments NOT being published.
I was grateful for anything being published because those were the days before we prised the lid off the opinion management machine and chucked some gravel in :-)
The JEP are still an evil anti-democratic force leading a naive and gullible population so it is good that there are some hand grenades in their machinery -and they just can't put the pins back !

I know that this belated lawyer-led enquiry will hide as much as it reveals and that no enquiry can reveal what has been made unknowable by the passage of time, the destruction of evidence and the untimely or otherwise deaths of victims or perpetrators.
Constable Michel Philip Le Troquer's speech was interesting (as boring aimless rambles go). All that hand wringing about the costs, you can tell that he wanted to vote against the COI, but like several of the others, he didn't want to be the odd one out in the playground.
Of cores Le Troquer is right that the COI will likely cost more than budgeted - but that's what happens when you start paying other people's legal bills.
Why are we paying them ? Perhaps Mr. Le Troquer would call me naive in saying that if you have done nothing wrong you do not need a lawyer.
If you have done something wrong; pay your own freaking legal bill ! - scope for savings surely ?
Le Troquer's residence in Jersey started in the 50's at Sacre Coeur Orphanage (Summerland) where his grandfather was Head Gardener and where his parents presumably also worked. Robbie Garner's book indicates that the vegetable gardens and other enterprises at Sacre Coeur utilised a regime what would now be considered as child slave labour. Along with the physical maltreatment (allegedly to the point of brain damage!) this provided perfect conditions where sexual abuse could (and allegedly did) occur under the noses of the Nuns.
Jimmy Saville visited Sacre Coeur, I wonder who else did.
The Le Troquers may have been "good" catholics and Innocent of any wrongdoing, or failed reporting / follow up.
Michel may be a lovely chap but other people's bad luck does seem to have followed him around like a bad small, from his earliest years to the present day. Perhaps the the COI will wash it off, or perhaps scratching the surface will make it worse.
Painful times, but at least we are alive to see them.

I don't think the Deputies should leave the States, but given what is happening with the Dean, he clearly should! He is clearly hopelessly conflicted in his many roles.
not once in my 30 odd years living in Trinity do I recall a Constable calling a meeting to discuss a forthcomming debate in the states,as far as I am concerned they sit there do very little,and take the money, they should not be in the states,on occasions the states run for as much as 3 days, so that is 3 days he or she is away and not available to their parish leaveing others to cover for them.

This was not just 'under the noses of the nuns' according to Robbie Garner and other people I know who were in that institution. One of the dumping grounds I ended up in before HDLG was a French convent. I was not aware of any sexual abuse but one or two of the nuns were quite free with beatings and canings.

If you mean the tort claim in London against Appleby International - have patience.
Whilst entertaining - it is not the highest priority.
Though I'm quite sure the international partners and stake-holders are going to be most interested - if that's the right word - to see the collection of real, real scum they've been associated with via Jersey.
I mean, the international clients of a global outfit such as Appleby International do have - as a serious priority - discretion.
It's not going to look to clever - really - it isn't - with the whole sordid and wretched mess tabled as evidence in London.

Not clear of their involvement in your cases? I thought that most of the problems were caused by Stephen Barker of (then) BakerPlatt, no?

What you seem to be saying indirectly by this article is that the Bailhache brothers' decisions while they were appointed to the roles of Attorney General may be linked to the business of their former legal practice either directly (in terms of a direct liability) or indirectly based on former lawyer-client relationships.

In the mainland press yesterday, the headlines were of the scandal of the Police hiding the criminal records of celebrities, politicians and others considered to be "high profile". These were not accessible to the vast majority of Police Officers on the grounds that, "Any sensitive, or high profile case will be restricted on our systems as we are not going to let 50,000 people (Met officers and staff) across London read sensitive material about celebrities, politicians and other high profile people". Thus spoke Metrolpolitan Police Commaner Peter Spindler.
He added that due to a number of Police officers leaking and selling information to the press, it was necessary to restrict access in the circumstances.
The Police National Database was not showing the records of such people to most Police officers.
The result was that the "great and good" may well have escaped being questioned, prosecuted and convicted, SaVILE included.
